How to bury the ghost of May 13

Politicians and civil society groups agree that the ghost of May 13 1969 should be buried, but only after the truth of that dark day in our history is told and reconciliation takes place.

Several politicians said fears of the unfortunate blood bath which happened in 1969 cannot be put to rest unless conclusive account of the incident is laid out.

DAP-Petaling Jaya Utara MP Tony Pua said one of the biggest problems of the May 13 incident was the lack of conclusiveness of the event that is often described as "sensitive".

"There are many stories to it. Therefore the formation of the Truth and Reconciliation Commission should be done to get an authoritative conclusion to put an end to rumour mongering, creating fictions and stirring of racial sentiments in interpreting the incident," Pua told theSun.

Public Accounts Committee (PAC) chairman and former Cabinet minister Datuk Seri Azmi Khalid told theSun history cannot be changed or forgotten, but many Malaysians may find discussing the racial riot in 1969 sensitive.

"To me, May 13 was part of a chain of events. The issues were many and history cannot deny it was racial in nature as there were many underlying factors to it. (However), unless facts can be presented most objectively, for the time being, it’s not advisable to discuss (the subject) openly," said Azmi in an SMS.

theSun columnist Tunku Abidin Muhriz, writing in Abiding Times on May 14, wrote that the "casualties of this day 41 years ago were, I believe, caused by the provocation of political actors". He said the way forward is for Malaysians of all races to tell the story of unity as it should be told.

"It is not the job of government to tell us who we are and where we are going. It is up to us, and the best thing the politicians can do is to get out of the way."

PKR’s strategic director Tian Chua said the incident should not be put to rest as Malaysians are constantly reminded of the horror as the society moves on.

He however said Malaysians have the courage and the sincerity to face the truth, thus many academicians and historians discuss the matter without drawing political connotations.

"(Only) then we can face it as a Malaysian society and (look for ways) to overcome the spectrum. If we can have this consensus in society on these two points, I think the ghost of May 13 will no longer be projected in a negative manner.

"Secondly, it is important that politicians of both sides stop using it as a means to intimidate and invoke fear. Whatever lessons drawn from it should not be used as a tool to invoke fear among any community," said Tian Chua.

DAP Youth Chief Anthony Loke said the matter should not be prolonged any longer; instead people should forgive and forget and move on.

"We should not keep discussing this. In this country, political leaders should talk about inclusiveness, spread message of peace that should be the focus instead of creating fear."

He said the younger generation may "not have any feelings" about the incident because they were not around during the incident.

"So why impose such fear in the younger generation? Why keep reminding them of the ghost? Looking at the world history, Japan and US were in war but nobody talks about the war anymore. The younger Japanese won’t say they hate the Americans for bombing them," said Loke.

Higher Education Minister Datuk Seri Mohamed Khaled Nordin said Malaysians need to draw lessons from the riot but said "no one should fear talking or learning about it".

"I believe Malaysian society is more matured now. The incident is not to be celebrated, people should remember on what can happen to our community," he said.

He said the younger generation are more educated and believed in the diversity of the country.

PAS-Shah Alam MP Khalid Samad said the May 13 incident can be discussed but it should be done responsibly.

"(However, it cannot be discussed) under the current administration as they seek to politicise for their own ends," said Khalid through SMS.

Hulu Selangor PKR by-election candidate and former Law Minister Datuk Zaid Ibrahim said there is no reason to be ashamed or to forget the incident as it is part of our history.

He however stressed that people should not use it as a "pernicious political weapon" to glorify violence or to make threats of violence "if their political demands are not met."

"That’s savage politics and must be condemned," said Zaid.

It was also reported that Umno Youth chief and Barisan Nasional Youth chairman Khairy Jamaluddin said it was inappropriate for anyone to hold a rally about the 1969 racial riots.

He was referring to the gathering planned by Gerakan Kebangkitan Rakyat in Terengganu on May 13 but was subsequently postponed indefinitely.

MCA deputy publicity chief Loh Seng Kok said any thought of a May 13 rally should be permanently decimated and anything that can re-ignite the old wounds must never even be considered.

MIC secretary-general S.Murugessan reportedly said: "May 13 is a bitter chapter in Malaysian history. We have put it behind us and are now moving forward with the 1Malaysia concept and the new economic model."

Many civil society groups have, from time to time called on the establishment of a Truth and Reconciliation Commission and constantly called for an open discussion and dialogues on the matter, urging Malaysians not to fear the past.

Haris Md Ibrahim, who is the co-ordinator of Saya Anak Bangsa Malaysia, said establishing the commission is important to understand what happened 41 years ago in order to bury the ghost once and for all, so Malaysians can move forward as a united nation.

Kuala Lumpur Selangor Chinese Assembly Hall Civil Rights Committee chairman Liau Kok Fah said it is high time the government declassify all documents related to the incident.

Former Transparency International executive director Richard Yeoh maintained that peace and harmony should be given through well-substantiated discourse and respect and not through incidents like May 13, which is used to intimidate legitimate expression and demands of the people.

"Despite the increasing number of Malaysians who are shunning away from politics of racism, there are, however, politicians, more so post-March 2008 have regressed," said Yeoh who is the Petaling Jaya city councillor.

MP fined RM3,000, risks losing post

Padang Serai MP N. Gobalakrishnan was fined RM3,000 by a magistrate's court here on Friday morning, putting him at risk of losing his seat in the Dewan Rakyat.

Magistrate Ainul Bashirah Dona Don Biyajib delivered the sentence after finding him guilty of voluntarily obstructing Chief Insp V. Saravanan from discharging his duties at Jalan Utama.

"The prosecution has proved a prima facie case against him," she said after both the prosecution and defence counsels submitted.

RSN Rayer, who represented Gobalakrishnan, applied for a stay of execution pending an appeal but Ainul Bashirah rejected it and ordered Gobalakrishnan to pay the fine.

Gobalakrishnan, who committed the offence at around 12.20am on Jan 29, 2002, was charged under Section 186 of the Penal Code for obstructing a civil servant from discharging his duties.

During mitigation, Rayer told the court that Gobalakrishnan is an MP and hoped that the court will only impose a fine of less than RM2,000 as a higher fine will disqualify him as an MP.

Deputy Public Prosecutor Suhaimy Ibrahim pressed for a deterrent sentence as obstructing a civil servant from discharging his duties is becoming rampant.

When contacted, DAP chairman Karpal Singh said Article 48 of the Federal Constitution stated that any MP who is fined more than RM2,000 will risk losing the MP post. "He has the right to appeal against the decision and must submit the appeal within 14 days from the decision," he said.

Gobalakrishnan paid the fine at around 3.30pm.

Zul agreed to the deal and the PM instructed Aziz to withdraw the election petition. Aziz was mad as hell (he knew Zul was dead meat) but he had no choice in the matter. He reluctantly withdrew the election petition and Zul was saved. But now Zul works for Umno, no longer for Pakatan Rakyat.


The issue is simple, really. Every candidate who contests the state and parliamentary elections is supposed to file a copy of his or her statement of accounts or statement of expenditure with the Elections Commission. This to ensure that no one violates the Election Offences Act by spending more than RM100,000 for a state seat and RM200,000 for a parliament seat.

Now, if you fail to file your statement of accounts/expenditure or your statement shows you have spent more than the allowed figure or your statement is in error, such as many expenses are missing from your statement, then the Elections Commission can disqualify you.

In short, you lose your seat.

Zulkifli Noordin, the PKR candidate who won the Kulim parliament seat in the 2008 general election, did not submit his statement of expenditure for the 2004 general election. And the Umno candidate who lost, Abdul Aziz Sheikh Fadzir, had proof of this. So Aziz filed an election petition to ask the court to disqualify Zul. (Remember Aziz, the man who wanted to burn down the Selangor Chinese Assembly Hall about ten years ago?)

Zul panicked. So he quickly doctored a set of accounts with forged documents and bills to buttress his case in court. Unfortunately, Zul got caught. Now it is no longer a simple case of failing to file your statement of accounts, which is a mere disqualification. It is now a case of fraud, which is a criminal offence that attracts a jail sentence.

The Prime Minister saw a golden opportunity in Zul’s predicament. Zul has been caught with his pants down. So the PM summoned Zul for a meeting and told the latter that Umno will withdraw the election petition and help save his arse. But he must first agree to a deal. And the deal is: Zul need not go to jail, but he would have to ensure the return of Kedah to Barisan Nasional.

In short, Zul will act as Umno’s Trojan Horse in Pakatan Rakyat.

Now can you understand why Zul is doing the things he is doing? No doubt it appears odd that Zul is doing all sorts of things that is hurting the opposition. But that was the deal. And once Kedah falls then Zul would have paid his dues and he can then officially join Umno.

When you lie to cover a lie you eventually get caught. And Zul got caught. If he had not tried to cover his mistake by forging his statement of accounts then at worse he just loses his seat. But because he forged his statement of accounts it is now more than a simple disqualification. It is fraud. And the crime of fraud is more serious. You can go to jail.

Umno just loves criminals. Criminals can be used. And since Zul made the mistake of doing something criminal, Umno is able to use him. And use him Umno did, and still is.


Kulim poll petition hearing put off to Aug 19


22 July 2008 (Malaysiakini) -- The High Court, which is due to hear the Kulim-Bandar Baharu election petition today, has postponed it to Aug 19.

This is the second time that the hearing for the election petition has been put off - the court was to hear the case two days ago.

Judge Balia Yusoff Wahi has last month set July 20 to hear the petition after dismissing preliminary objection raised by the winning candidate Zulkifli Noordin from PKR to strike out the petition.

The petition was filed by Umno candidate Abdul Aziz Sheikh Fadzir on the grounds that Zulkifli had failed to submit his statement of expenditure from his 2004 general election campaign.

Under the Election Act, candidates who do not submit their statement of expenditure to the Election Commission can be disqualified from contesting in future elections.

In the 2004 general election, Zulkifli contested the Kuala Langat parliamentary seat in Selangor but lost to Umno's Dr Shafie Mohd Salleh.

In the election petition, Abdul Aziz also claimed that the returning officer had failed to act against Zulkifli despite having documents confirming his failure to submit the statement of expenditure.



Aziz Sheikh Fadzir Withdraws Petition Against Zulkifli Noordin

ALOR STAR, 13 Oct 2008 (Bernama) -- The Alor Star High Court today struck out the election petition for Kulim/Bandar Baharu parliamentary seat after Barisan Nasional (BN) candidate Datuk Abdul Aziz Sheikh Fadzir decided to withdraw the petition.

Justice Datuk Balia Yusof Wahi made the decision after Abdul Aziz's counsel, Firoz Hussein Ahmad Jamaludin told the court of his client's decision.

The withdrawal allows Parti Keadilan Rakyat (PKR) candidate Zulkifli Noordin to continue as MP for Kulim/Bandar Baharu.

In the petition filed by Abdul Aziz in April this year, he had named Zulkifli, the returning officer and the Election Commission (EC) as the first, second and third respondents respectively.

Abdul Aziz had sought that the court declared the March 8 election results for the Kulim/Bandar Baharu seat null and void. Zulkifli won the seat, polling 22,255 votes against Abdul Aziz's 16,672 votes.

In the petition, Abdul Aziz claimed that Zulkifli had failed to submit his statement of expenditure when he contested the Kuala Langat parliamentary seat in the 2004 general election, which contravenes the Election Act.

He also claimed that the returning officer had failed to act against Zulkifli's nomination despite the fact that the EC had the documents confirming Zulkifli's failure to submit his statement of expenditure.

Abdul Aziz when met outside the court said that his decision to withdraw the petition was made after a discussion with BN leaders.

He said the decision was made after taking into consideration the current global economic instability and the price hikes caused by the erratic oil price, the increasing depression felt by the people and various other problems that needed attention.

"In the interests of the people in Kulim Bandar Baharu and the country, I am willing to sacrifice my right to challenge Zulkifli so that the people and the government can work together to stabilise the country's political situation, economy and unity that are in critical condition right now," he said.

He said that he also respected the decision made by the voters in the March 8 general election and would continue to serve the people in Kulim Bandar Baharu through a Barisan service centre that he had set up since April.



BN withdraws Kulim-Bdr Baru election petition

He said that he also respected the decision made by Kulim-Bandar Baru voters in the March 8 general election.

Abdul Aziz also said that he would continue to serve the people in Kulim-Bandar Baru through a Barisan service centre that he had since set up.

Kedah state assembly won’t be dissolved - MB

Datuk Seri Azizan Abdul Razak, the Mentri Besar of Kedah said that the state assembly will not be dissolved after Zulkifli Noordin, the independent Member of Parliament publicly warned that there would be a ‘second Perak’ coming along. Azizan said that the government will be keeping a close guard on its PR (Pakatan Rakyat) assemblymen to ensure that they do not ‘cross-over’ like the 3 in Perak who eventually caused the fall of the PR’s administration in Perak. He said “I just had a discussion with them last night and I am very confident of their loyalty. There is no problem in the PR. The only problems are the assemblymen from Barisan Nasional. If he said that the Kedah majority is small, then how did the Kelantan (PAS) government manage to stay in power with only a one seat-majority? If other PKR members think like Zulkifli, then not only a few will jump — he cannot declare that a few will jump like him because we are all on good terms in PR,”

He also told Zulkifli to step down because “The people no longer support him... he is no longer credible in Kedah. If he is brave then he should resign and stand for re-election. If he really thinks that he has influence then he should resign and we will let our branch leader to go against him.”

Currently , the Pakatan Rakyat has 20 out of the 36 seats in the state assembly with 14 belonging to the BN and another 2 independents.

Rosmah referred to as 'First Lady' by United States

Rosmah Mansor was constantly referred to as 'First Lady' by the United States while she was at the International Peace and Harmony Award held in New York. It seems that Americans are ignorant and have no idea that according to Malaysia's monarchy system, only Raja Permaisuri Agong carries the title.

While the term 'First Lady' is appropriate to use for wife of their President, it differs in Malaysian context as only Raja Permaisuri Agong is entitled to use it. Apparently, Rosmah was constantly referred to as the 'First Lady' on her visit to New York to accept the International Peace and Harmony Award presented by former Secretary of State Lawrence Eagleburger.

Prior to the event, a full-colour advertisement was published in the New York Times to welcome and celebrate Rosmah's arrival. Rumours spread like wildfire that the the ad is sponsored by a company affiliated to Sarawak Chief Minister Abdul Taib Mahmud.

The body copy of the advertisement states, “ Welcome to New York. Her Excellency, Datin Paduka Seri Rosmah Mansor. First Lady of Malaysia.” The award presented is meant to recognize Rosmah's charitable efforts besides to celebrate bilateral relations between Malaysia and United States.

Some blogger wrote an entry saying that Najib and Rosmah have apologized to the Yang Di Pertuan Agong and Raja Permaisuri Agong on the advertisement that appeared in the New York Times.

Wee quits PKR

The Wangsa Maju Member of Parliament, PKR (Parti Keadilan Rakyat)’s Wee Choo Keong has announced his resignation and will remain as an independent. This came as no surprise to many as he was widely expected to leave PKR following the resignations of his other ‘colleagues’ recently after he came out to join them in criticism Lim Guan Eng, the Chief Minister of Penang. He had earlier denied the claims that he is planning to leave PKR after being asked by reporters after the resignations of the others.

Wee was formerly with the DAP when he won the Bukit Bintang MP seat where he then left to form the MDP (Malaysian Democratic Party) before joining PKR where he won at the Wangsa Maju constituency. He cited that the reason he is quitting is because he was disappointed with the way the PR (Pakatan Rakyat) handled the claims against Kumpulan Semesta Sdn Bhdm, a Selangor government owned company on grounds of corruption. He also told local news portal MKini to "Wake up and not be made a fool of by irresponsible and insecure persons,"

Kit Siang to demand apology from cabinet to Aminulrasyid’s family

DAP stalwart Lim Kit Siang is calling on the cabinet to formally apologize to family of Aminulrasyid Amzah, the 14 year old boy who was shot by the police recently where he said that he will help the family in seeking the apology from those involved and will raise the issue in the cabinet. Local Chinese newspaper Sin Chew Daily reported that the prime minister Datuk Seri Najib Tun Razak has issued a football betting license to Berjaya Group. This came in the wake of some serious protests against the move by various religious and civil groups as well as those from the opposition front for legalizing sports gambling. The issuing of the license was seen as legalizing gambling which is widely perceived as a social ill in the country. Tony Pua, the national publicity secretary of DAP said that party is slamming the prime minister Datuk Seri Najib Tun Razak of ‘cronyism’ for awarding the sports betting license to the chairman of Berjaya Group, Tan Sri Vincent Tan because he did not us an open tender process. May 13 rally called off

The May 13 rally organized by Gertak (Gerakan Kebangkitan Rakyat) themed ‘Melayu Bangkit’ has been ‘postponed’. According to Razali Idris, the chief of the movement said that this is because they were ‘instructed to do so’ and that since the former prime minister Tun Dr Mahathir had chosen the date, it would be him who would choose another one. The event was expected to be attended by some 10,000 people to commemorate the anniversary of the darkest chapter in Malaysian history. Razali said “We had decided to postpone it after we were instructed by the country’s top leadership, who are worried about the security situation, after political parties manipulated the event for their interest. The date for the event was chosen by Tun so we will let him decide when will be the suitable substitute date. The instruction to call off the gathering had reached him via the Terengganu Integrity Institute, the event’s co-organiser, early this evening.”

The rally was both slammed by leaders from both sides of the political divide of BN (Barisan Nasional) and PR (Pakatan Rakyat). Razali added that “The attacks are coming from parties who do not understand the true spirit of the gathering and are malicious in nature. They are the ones who are ruining the idea. We are not threatening anyone. It’s just an event to remind the Malays of what had happened on that fateful day so it won’t happen again in the future. The Malays were united in the fight for independence but after that, at that point on May 13, the Malays were weak, divided. Our economic status was low,”

IGP cannot apologize as there would be ‘legal implications’

The IGP (Inspector-General of Police) said that he will not be apologizing to the family of Aminulrasyid Amzah, the 14 year old who was shot by the police recently in the highly controversial case stating that if he did, then there would be ‘legal implications’. This came in light after the family of the teenager who died in the shooting called for the police to apologize for accusing him of being a criminal.

Musa said “I will not answer that, doing so will have legal implications.” Latheefa Koya, one of the lawyers representing Aminulrasyid’s family said “By refusing to apologise and admitting that the police were wrong, they have not only made it worse but may have committed criminal offence by perverting course of justice and fabricating evidence during the investigation. A photo of a parang was shown to our clients, where did it go?” while N Surendran said “Musa’s comments were absurd, and instead stated that legal implications would only take place if they did not apologise. Since he had made the statement, it is incumbent upon him to apologise. It is not that there will be legal implications if he apologises, but there will be legal implications if he does not because it will be considered as abetting in the fabrication of evidence,”

Ex-cop jailed for gang robbery

An ex-police constable was sentenced to eight years’ jail after he was found guilty of committing gang robbery nearly two years ago.

Sessions Court judge Rozina Ayob ordered Mohd Syam Manar, 29, to serve the sentence from the date of his arrest on Jan 29 last year.

In passing sentence, Rozina said the prosecution had succeeded in proving the case beyond reasonable doubt.

She said the accused also failed to prove that he was not colluding with two others, who are still at large, in the robbery.

Mohd Syam, who represented himself in the trial, was charged with robbing Nurul Huda Mohd Zakaria, 23, of her motorcycle at NPE, near Wisma Peladang, Petaling Jaya, at 11pm on Dec 3, 2008. — Bernama

Lawyers for Aminul’s family want to meet Hishammuddin

Lawyers acting for Aminulrasyid Amzah’s family will seek a meeting with the home minister to push for a separate investigation into the possible “fabrication of evidence” to cover-up the fatal police shooting of the schoolboy.

N. Surendran said the alleged false evidence includes statements that a parang was found in the Proton Iswara driven by the Form Three student and that he had attempted to ram the police by reversing into them before they opened fire on the car on April 26.

“We will raise the issue with Datuk Seri Hishammuddin Hussein next week,” he told The Malaysian Insider today.

The lawyer said fabricating evidence amounted to perverting the course of public justice and was a serious offence.

“Despite the strong evidence, it looks like no investigation into the allegations had started.”

Surendran said they will also be asking Hishammuddin to look into claims by key witness Azamuddin Omar, who was in the car with the dead schoolboy, that he was assaulted by no fewer than five policemen.

The 15-year-old son of a police sergeant had also claimed that a policeman nearly opened fire on him when he fled the scene.

Surendran also slammed Inspector General of Police Tan Sri Musa Hassan and Selangor police chief Datuk Khalid Abu Bakar for refusing to apologise to Aminulrasyid’s family.

“We will leave it to the public to judge them. It is incredibly insensitive of them for not being able to admit to mistakes.”

Instead, Khalid yesterday had asked the family to apologise for allowing a minor to drive without a licence.

Surendran said it was cruel and heartless of Khalid to blame the family and the statement showed a complete lack of sympathy for them.

Khalid’s remarks were also inconsistent with the Attorney-General’s move to charge police Corporal Jenain Subi on Monday for culpable homicide not amounting to murder for shooting Aminulrasyid.

“It looks like the authorities are sending out mixed signals.”

He stressed that Aminulrasyid was not a criminal and his only offence was joyriding, which amounted to a road traffic offence.

“He certainly didn’t deserve to die.”

The 14-year-old’s uncle, Kamaruddin Hassan, today also said the police must explain the false allegations in the press which labelled Aminulrasyid a criminal immediately after the shooting.

“While Khalid has denied making the statement to the press but the media had reported it. Does it mean these reports are untrue?” he asked.

Kamaruddin said if indeed reporters had misquoted Khalid, then he should take action against them.

PAS slams May 13 Malay gathering

PAS has slammed the involvement of a government agency in a mammoth gathering of right-wing Malay groups in Kuala Terengganu on May 13, the 41st anniversary of the country’s deadliest race riots.

The Terengganu Integrity Institute has been listed as “cooperating” with a group calling itself Gerakan Kebangkitan Rakyat (Gertak) to organise the rally with the theme “Malays arise” at the Gong Badak indoor stadium in two days time.

The May 13 rally was reported by Umno-owned Utusan Malaysia yesterday.

Utusan Malaysia said the rally will be attended by 10,000 members from 45 Malay non-governmental organisations, and is aimed at uniting the Malays. Former Prime Minister Tun Dr Mahathir Mohamad, will be attending.

PAS vice-president Salahuddin Ayub called the event “uncivilised” and chastised the agency’s involvement as unethical that would taint the Najib administration’s all-inclusive 1 Malaysia.

“This is outrageous and unhealthy . The incident should not be raised at this point of time when we have already gained independence and the government is trying to promote its 1 Malaysia concept using APCO, paying RM77 million to market it.

“They said the date was chosen to commemorate the race riots. This is so uncivilised. It’s not just the Malays, Indians and Chinese but any civilised person would not want to be associated with this kind of mentality,” Salahuddin told a press conference here.

The Kubang Kerian MP said links with such event would mar the commendable efforts of the Malaysian Integrity Institute — the agency’s federal umbrella — to improve governance.

“I urge the director-general to take action against its errant Terengganu branch,” added the PAS leader.

PAS secretary-general Datuk Mustapha Ali who was also present at the press conference said the agency’s Terengganu branch was headed by an Umno man, Razali Idris, which explained the body’s role in the programme.

“All this May 13 sentiments is only played by Umno,” said Mustapha, in backing his explanation.

He disclosed that he contacted the Malaysian Integrity Institute director general, who claimed he is aware of the programme but said he would not be attending.

Mustapha did not reveal the details of the conversation between them nor did he mention if the director general had approved or disapproved the event.

The PAS leader then questioned Dr Mahathir’s involvement with the event. The former premier has attended several events by Malay rights groups such as Perkasa which observers say signalled his endorsement of their agenda.

“If you remember, Mahathir was a controversial figure in the May 13 riots. My question to him is: is he trying to resurrect the ghosts of May 13?” Mustapha said.

Charge against Anwar and Saiful’s statement contradicts, Karpal move to impeach Saiful

Karpal Singh, the defence lawyer representing opposition leader Datuk Seri Anwar Ibrahim in the sodomy case involving alleged victim Mohd Saiful Azlan Bukhari has moved to impeach Saiful from the case where while he claimed that the intercourse has been non-consensual, Anwar is being charged for consensual sex against the order of nature under Section 377b. This means that the court is now faced with its own contradiction where the charge against the accused differs from that of the testimony of the main witness. Karpal said "Clearly, there is a serious discrepancy with the charge with what the witness had maintained with the questions posed earlier. Therefore, the defence is applying for Saiful's statements that he made under Section 112 of the Criminal Procedure Code, to see why there is such a discrepancy.”

He added that if the defence team could prove the contradiction, the prosecution's case would collapse. “Of course, that's the end of it. It should be the end of the case," Anwar added and said "It's the first time in a criminal case in this country that you have a statement to the police saying that the act was not consensual and yet the charge is consensual. It is questioning the credibility of the prosecution. They looked at the evidence, they can't prove it so they changed (the charge). Saiful is not consistent, he is not telling the truth, so that's why we want the full statement."

Sodomy trial postponed to tomorrow, Saiful claims doctor lied

The sodomy trial involving opposition leader Datuk Seri Anwar Ibrahim and the alleged victim Mohd Saiful Bukhari Azlan has been postponed to Tuesday after Karpal Singh, the defence lawyer applied for a postponement to make a full submission on getting the caution statement from Saiful. Saiful is being cross-examined by the defence in the high profile case which if convicted, Anwar could face a jail sentence of up to 20 years.

Saiful has implied that one doctor from the Kuala Lumpur Hospital was lying after Karpal read the copy of the report which stated that the pain which Saiful had complained on his stomach and anus was caused by a plastic object into his anus. To this, Saiful claimed that the report was wrong and that "It is not true. Possibly the doctor is lying." Karpal had at the start of Monday’s session insisted for the witness list to be provided to the defence team only to have it struck out again. Lawyers for opposition leader Anwar Ibrahim today sought to implicate the country's prime minister in a conspiracy to frame Anwar on charges that he sodomised a former male aide. Prime Minister Najib Abdul Razak has admitted meeting Anwar's accuser, Saiful Bukhari Azlan, after he said he was sodomised by Anwar but before a complaint was made to the police in March 2008.

Najib has also denied interfering in the case.

Saiful told the court that he met Najib on March 24, two days before his deposition stated that the 63-year-old opposition leader had sodomised him, a crime in this mainly Muslim country, and four days before he went to the police.

"I told him (Najib) about my problems," a nervous-looking Saiful, now 25, told the Kuala Lumpur High Court on the first day of his cross- examination by Anwar's lawyers.

He did not elaborate on what his problems were.

If convicted, Anwar could be jailed for 20 years, a sentence that would effectively end the career of the man who has succeeded in uniting Malaysia's opposition rainbow coalition of Islamists, reformers and ethnic Chinese political parties. Anwar was convicted of sodomy in 2000, adding to an earlier sentence for corruption, following his ouster as deputy prime minister at the height of the 1998 Asian financial crisis.

The earlier sodomy conviction in a trial that was widely criticised for being unfair was overturned on appeal. That left Anwar free to contest a parliamentary seat after polls in 2008 that saw the government that has now ruled Malaysia for 52 years fall to its worst ever results in national and state elections.

The political uncertainty combined with the global financial crisis saw foreign investors flee Malaysia and despite the promise of economic reforms and a return to strong economic growth in Asia's third-most trade-dependent economy, they have not returned.

Najib was deputy prime minister at the time of the alleged sodomy and took the top job in April last year, pledging to open up the economy and mend tensions between the majority Malay and minority ethnic Chinese and Indian populations.

"The prime minister is involved. There is a political conspiracy to eliminate Anwar from his seat," defence lawyer Karpal Singh told the court.

Karpal on Monday also challenged Saiful's claims that he had been sodomised, saying they were not backed up by a medical report.

The trial is due to last until August.

Anwar says it is Malaysia on trial. Lawyers want to ‘grill’ Saiful

Datuk Seri Anwar Ibrahim, the opposition leader and the trial where he is accused to have sodomized Mohd Saiful Bukhari Azlan will return to court on Monday where the alleged victim will be cross-examined. Anwar said that it is Malaysia which is on trial and that “Malaysian justice had deteriorated under Prime Minister Najib Abdul Razak, who came to power a year ago.” He said “It is not Anwar's case. It is the institution of governance -- the police, the judiciary and certain media -- which have all got worse under Prime Minister Najib Razak. They are the real ones on trial. I am committed to political and economic reforms. There is no turning back. Of course I am a political threat. They have been trying for 12 years to kill my political career. I leave it to my supporters and Allah to believe in me.”

According to Sankara Nair, a lawyer in Anwar’s defence team, “The prosecution's refusal to release information such as its witness list and key documents on forensic and DNA evidence was problematic. Anwar is put in a very severely disadvantaged position. The defence faces an uphill task as vital documents in relation to Anwar's defence have not been given to us by the prosecution. The defence team would cross-examine Mohamad Saiful when the hearing opens Monday. We intend to grill this witness. The court has set four days for this hearing. Hearing dates have been set until August but Sankara said he did not know when the trial would end.”

I am happy to hear Anway say that I was previously in UMNO. I did UMNO things consistent with UMNO policies. So whatever Nalla Karuppan, Ezam, Chandra, Zul and the whole gang have been threatening to reveal, for ages now, nothing should surprise us. We all know that he was a big chief in UMNO with a lot of power as DPM and Finance Minister. I will be surprised only if he says that he was very clean.

Police apologise for shooting another boy

The police have apologised for the shooting of a teenager in Gemencheh early today, and have detained a policeman over the incident.

The latest case comes just two weeks after a schoolboy, 14-year-old Aminulrasyid Amzah, was killed in a police shooting.

Negeri Sembilan police chief SAC I Datuk Osman Salleh told reporters he has apologised to the family of the boy in today’s shooting.

Osman also confirmed that the officer involved was currently under investigation for failing to follow the standard operating procedure in the discharge of firearms.

“We have suspended him as he violated the Inspector-General of Police’s Standard Orders on when a policeman is allowed to open fire.

“Since the lives of the policemen were not in danger, he should not have opened fire,” he said.

According to reports, the police constable was alleged taunted by the motorcyclist who he kept weaving in front of the patrol car at 3.30am today.

The policeman, who has been in service for one-and-a half years, then fired a shot after the cyclist repeatedly refused to pull over.

Mohd Azizi Aziz, 17, was shot in his hip and has since undergone surgery at the Tuanku Ja’afar Hospital.

Osman said preliminary investigations indicated that the policeman did not intend to shoot the victim.

“He took out his pistol from the left window and wanted to fire a warning shot but it hit the victim. We will, however, have to verify this,” he said.

Mohd Azizi is the second case since Aminulrasyid was fatally shot 100 meters from his house.

Police alleged Aminulrasyid had tried to ram into police officers in Section 11, Shah Alam, causing them to open fire in “self-defence.”

However, this has been disputed by Azauddin Omar, 15, the lone passenger in the car when the 14-year-old was shot in the back of his head.

The government has since set up a special panel, headed by Deputy Home Minister Datuk Abu Seman Yusup, to investigate into the shooting.

Abu Seman has said that action would be taken if the officers involved were found to be at fault..

“If the policeman is found to have been negligent, we will let the law take its own course,” he said during a press conference.

Cops say did not rough up Kelantan royalty




Kelantan police today denied allegations that they had acted violently against members of Kelantan royalty who wanted to visit the Sultan of Kelantan Tuanku Ismail Petra at the Universiti Sains Malaysia Hospital here.

Kelantan deputy police chief Datuk Amir Hamzah Ibrahim said there was no violence whatsoever occurred during the visits as alleged by certain quarters.

He was commenting on media reports concerning the disappointment of Kelantan royal household members who alleged that the police had acted violently and refused to let them visit the Sultan (above) who has been undergoing heart treatment at the hospital since Tuesday.

The Sultan’s uncle, Tengku Seri Utama Raja Tengku Abdul Aziz Tengku Hamzah was reported as saying that the police only allowed certain individuals to visit the ruler.

Amir said ever since the Sultan was admitted to the hospital, the Kelantan Regent, Tengku Muhammad Faris Petra, had issued a decree that the security for the Sultan to be increased and all visitors should get the Regent’s consent.

Tengku Muhammad Faris had also listed the names of five people who could visit the Sultan, except for hospital staff attending to him, he said.

“In the list, those five members of the royalty who are allowed to visit the Sultan are the Raja Perempuan Tengku Anis Tengku Hamid, her second son Tengku Bendahara Tengku Muhammad Faiz Petra, daughter Tengku Amalin A’ishah Petra and two other close relatives.

“It doesn’t mean that the other members of the royalty will not be allowed to visit the Sultan. They just have to get the consent from the Regent first. If they have the Regent’s consent, the police will not stop them,” he said.

On the identity of the man who is alleged to have shot a Kelantan palace guard last week, Amir said the man was a local and in his 40s.

Police interrogations on the man were still ongoing, he said.

In the incident on May 1 in Tumpat, the palace guard, Ramli Mohamad, 50, sustained severe injuries after being shot by an unidentified suspect at Kampung Kok Keli, three kilometres from his house.

Meanwhile, the Sultan’s medical specialist, Dr Amir Ramli, today proposed that the panel of 10 medical specialists appointed by the state government yesterday, examines the Sultan when he was perfectly calm and had enough rest.

He said the Sultan had not slept well since he was admitted to the hospital.

“Tuanku Ismail has yet to undergo speech therapy while occupational therapy could only be done two days after his admission,” he told a press conference here. — Bernama

Anwar vows Ho Leng’s independence as Pakatan MP

Datuk Seri Anwar launched the Sibu by-election campaign last night, promising that Pakatan Rakyat candidate Wong Ho Leng would be free to speak up if elected, and won’t be under the thumb of national leaders.

The Opposition Leader who spoke at three public rallies last night made the pledge to quash fears among Sibu voters that the state DAP chairman would not be able to voice out the concerns of his constituents.

“I am supporting him here because we want a representative for the people of Sibu,” said Anwar at a rally in the predominantly-Chinese Sibu town.

“If there is any disagreement we allow disagreement then we sit down to discuss because we take things seriously,” said the PKR de facto leader.

The process of naming the PR’s Sibu candidate was delayed twice last month before Wong’s name was announced resulting in speculation by their opponents in SUPP and Barisan Nasional (BN) that the Sibu and Sarawak DAP are not free from West Malaysian control.

Wong’s opponent in the contest SUPP’s Robert Lau Hui Yew was announced soon after the death of five-term MP and Transport deputy minister Datuk Robert Lau Hoi Chew by the party’s Sibu division before getting the official endorsement from national BN leadership.

Maintaining some form of independence from mainland leaders is seen as an important factor by the parochial voters of East Malaysia.

Anwar also pointed to the 500-strong crowd at the rally that DAP secretary-general Lim Guan Eng who runs the Penang government has previously displayed disagreement with PR leadership.

“I am not an idol for him to worship. They (DAP leaders) are not like those from SUPP or MCA who every time they meet Datuk Najib, they will just agree with him,” said Anwar who was later introduced by Wong at the rally as the prime minister in waiting.

This is the Bukit Assek assemblyman’s fourth tilt at the Sibu seat, having lost in all previous occasions in 1995, 2004 and 2008 general election. The May 16 by-election is a must win for both BN and PR to show the respective party’s preparedness for the state election that must be held by July next year.

The opposition made its best ever electoral performance in Sarawak in 2006 winning six of the 71 state assembly seats.

The support level for the opposition however was reduced in Election 2008 when DAP only won the Bandar Kuching seat.

PR also needs to win the election in order to increase its representation in Parliament after losing four MPs to resignations and sackings.

PKR lost another parliamentary seat recently when it failed to defend the Hulu Selangor constituency in last month’s by-election.

PR controls 77 seats with PKR having 25 MPs, DAP, 28, PAS, 23, and PSM, 1.

The Sabah-based SAPP has two seats. There are five independents.

BN controls 138 seats in the 222-member Parliament
