Zaid insists rulers are subject to Constitution




Datuk Zaid Ibrahim (pic) said today that Rulers’ orders can only become law after going through the legislative process or the country risks ending up a Caliphate.

“If the power to issue orders and directives in matters pertaining to Islam is given to the Rulers without having to go through the legislative process... that would mean we are back to the era... where Caliphs could enforce the law without referring to any other party,” he said today.

Zaid was responding to criticisms levelled at him for questioning the right of the Selangor Sultan to issue a decree that mosques should not be used for political purposes.

He said that Malaysia is a constitutional monarchy and, as such, Rulers must abide by the rule of both state and federal constitutions.

The former de facto law minister explained that the power given to the state under Article 74 and 80 of the Federal Constitution to make laws pertaining to Islam is granted to the state’s legislative authority.

“That authority, in my opinion, is the state legislative assembly,” he said.

Zaid had written on his blog earlier this week that the Sultan of Selangor must go through the state legislative assembly to issue orders pertaining to Islam.

The Selangor Islamic Religious Council (Mais) then wrote to him warning him that it was an offence to dispute any order or directive by the Sultan under Section 12 of the Syariah Offences Enactment.

Mais also argued that the Sultan’s pronouncements have the force of law without the need for gazetting.

“Even laws passed by Parliament or by state assemblies you have to gazette. The reason for the gazetting is so that people know what exactly is prohibited,” Zaid said.

“But if the ruler can make orders and decrees that have the force of law, that… don’t have to be gazetted, [that] don’t have to go through the process of the assembly, how do we know what exactly is the scope of that order?”

The former lawyer said it was not his intention to belittle the rulers by questioning the legal limits of their powers.

“It is the legitimate right of every citizen, including myself, to raise the issue.”

“These are issues of public interest and, as a politician, it is my duty to give my views.”

Zaid said he was prepared to seek an audience with the Sultan to explain himself.

He also said that the questioning of legal interpretation should be encouraged.

“We must be able to talk as a democracy about the legal process and the legal provision without fear of being ridiculed.”

He added that he was ready to refer the matter to the Federal Court with Mais “to ascertain the true interpretation of the Federal Constitution and the function of the state legislative assembly”.

PAS did not pay Kickdefella RM4m

Datuk Mustafa Ali, the secretary-general of PAS has denied claims that they had paid some RM4 million to Syed Azidi Syed Abdul Aziz a blogger who goes by the name Kickdefella to discredit the former prime minister Tun Abdullah Ahmad Badawi. The claims were made by Syed Azidi where he has since been called in by the MACC (Malaysian Anti-Corruption Commission) twice to have his statement recroded. Mustafa said that he has already checked with the Kelantan state government as well as the party and found that no one had given out such an amount to the blogger.

He said "The alleged money did not come from PAS. Syed Azidi is answerable to the money he claimed to have received. After he was sacked from the Kelantan Mentri Besar Corporation, he started with all sorts of exposures. So what is his purpose or motive? It is the goal of any political party to strive hard to bring down the government administered by its opposition via democratic channels, but it is not PAS's agenda to topple a particular leader. Therefore, not only am I not aware about the RM4 million accusation (by Syed Azidi), it is not our agenda to do that because under the Islamic struggle, we fight against policies instead of individuals. We fight against BN because of its policies which are contradicting ours. If we toppled Abdullah, (Prime Minister) Datuk Seri Najib Abdul Razak will rise and it makes no difference,"

He added that “Abdullah stepping down in 2008 was the result of Umno leaders who wanted him to leave and not due to outsiders. Whatever exposed (by Syed Azidi) on Pak Lah (Abdullah) has nothing to do with PAS nor its struggle. Since he (Syed Azidi) has submitted documents to the MACC, let the commission to do the investigation. It is now up to the MACC to do whatever it can for the investigation. There is nothing PAS can do now,"

Umno to work with MCA including attending weddings and funerals to win back Chinese – Khir Toyo

Datuk Seri Dr Mohd Khir Toyo, the former Mentri Besar of Selangor said that Umno will be working together with MCA to try and woo back the Chinese community and voters to the BN (Barisan Nasional) fold. This came in light after the recent drop in Chinese supporters who voted for the BN (Barisan Nasional) in the recent by-election of Hulu Selangor.

He was speaking to Chinese newspaper Nanyang Siang Pau that “This was the instruction given to Umno division chiefs by Umno and BN chief Datuk Seri Najib Abdul Razak at the recent Umno brainstorming camp. By participating in activities such as Chinese weddings, funerals and community work, among others, Umno hopes to get closer to the Chinese and understand their needs and views. The brainstorming session analysed the Hulu Selangor by-election result and how Umno could win back the support of the Chinese. The conclusion was that the party has to get closer to the community. Umno state liaison committees must submit reports to Najib, who wants to know our answer.”

MCA hits out at Penang opposition leader for May 13 remarks

Loh Seng Kok, the deputy publicity chief of MCA has slammed Datuk Azhar Ibrahim, the opposition leader of the Penang State government for his remarks that May 13 might repeat if the people lose confidence in the police force, saying that such remarks were seditious. Loh said that Azhar had “made references to inciting racial riots, and that “elected representatives should be reminded that the immunity of the state assembly is not a carte blanche to misuse the freedom of speech which is given.” He added that “MCA regrets the remarks made by Azhar which warn of a repeat of May 13.

That remark, along with his statement of Malay gangsters ‘to teach a lesson’, is hurtful and insensitive to the feelings of decent Malaysians, as well as an insult to the Malays as it portrays them to be a violent race. Azhar’s statement could jeopardise foreign direct investments into Penang as “many multinational companies park their factories in Penang. By asking the army to take over, Azhar may have struck fear into Malaysians with images of the Emergency period coming back to those who have lived through that era. After 53 years of independence, it is disappointing to see that threats are still being flung around the august House. While constructive criticisms are welcomed, threats are not. MCA also rebukes Azhar’s statement as they are contradictory to our prime minister’s vision of a 1 Malaysia and, as a result will repel voters from supporting the BN coalition. Controversial statements like Azhar’s should altogether be avoided by politicians lest we lose the support of the people,”

Dr M tells Umno to put Malays first

Former Prime Minister Tun Dr Mahathir Mohamad articulated today a widely held sentiment in Umno — that going after the Chinese vote is risky and unproductive.

Instead, he appears to suggest in a posting on his blog today that Umno should first ensure that Malay interests are taken care of, especially in the face of what he called “attacks by the Chinese.”

“We hear a lot about demands by Chinese extremists questioning the provision of Malay special rights in the constitution, demanding an end to the NEP, [a] reduction of quotas for Malay students. They even say the Malays are also ‘kaum pendatang’ or immigrants. An article even claims that there is no such thing as a Malay race.

“Umno remained silent. In fact when an Umno member said that the Chinese and Indians are descendants of immigrants, he was suspended by Umno. It seems to many Malays that Umno is incapable of countering the attacks by Chinese extremists against Malays,” wrote Dr Mahathir.

His latest remarks are expected to put more pressure on Prime Minister Datuk Seri Najib Razak, who has been pushing his 1 Malaysia agenda to unite the country.

But while Najib has had mixed results in reaching out to Indian voters, the results of ten by-elections since Election 2008 showed Chinese voters have now become a solid vote bank for Pakatan Rakyat (PR).

Dr Mahathir warned today that Umno and Barisan Nasional (BN) risked losing Malay support if they continued to introduce “Chinese-friendly” policies and abolishing affirmative-action measures under the New Economic Policy (NEP).

“The BN must remember that in the 2008 election it lost a lot of seats. Where it won the margins are very small. If a few hundred Malays decide not to vote BN, even the seats that it had won would be lost in the 13th General Election.

“Umno and the Government are facing a dilemma. In trying to win over the Chinese with allocations and abolishing New Economic Policy provisions, the BN will lose Malay support as indeed it did in 2008. On the other hand no matter how the Government try to satisfy Chinese demands, the Chinese have clearly rejected the BN,” said Dr Mahathir.

Dr Mahathir also justified the existence of Perkasa as a reaction by Malays to what he suggests were the increasingly strident demands of Chinese voters.

“Perhaps it is because Perkasa appears to be racist that the Chinese are against BN. But Perkasa is not BN. Also the Chinese parties in BN are facing a crisis.

“What is happening now is that Malays are forming Non-Governmental Organisations because of Chinese attacks against the Malays and Umno seems unable to defend them.

He said that groups like Perkasa feel that they have to rebut “racist” statements by the Chinese.

“And when they do they are labelled as racists.”

Opposition slams govt for considering legalizing sports betting

Leaders of the opposition front PR (Pakatan Rakyat) has hit out at the government for even considering the legalizing of sports betting as a means to ‘curb illegal betting’ saying that that government is prioritizing profit over social well-being and had started an anti-gambling task force to go against the decision, if the government agrees to it. Anthony Loke, the youth chief of DAP said that this issue had been discussed a few months ago but nothing has come out of it until now.
He said “This move shows that the government works in secrecy. There was never any consultation with the public and I am sure that the public would have a different opinion on the issue. The government is very desperate to raise its revenue to bridge the wide deficit gap. But what they are doing is encouraging gambling in society, especially among the young. More people will get into gambling, which will spill into more social problems like the spurring of loan sharks. It will tear apart the social fabric,”

Dr Dzulkefly Ahmad, a member of the PAS Central Working Committee too slammed the BN government saying that “The Barisan Nasional (BN) government had compromised its own morality by agreeing to legalise sports betting. I question what is in the conscience of (Prime Minister Datuk Seri) Najib (Razak) and especially all the muftis who are backing the BN government. In one breath, he is portraying this virtuous image, but on the other, he is allowing what then-premier Tun Abdullah Ahmad Badawi had to put on hold,”

Kedah BN prepares for takeover or state polls




Kedah Barisan Nasional (BN) is bracing itself for a possible ousting of the Pakatan Rakyat (PR) state government or fresh polls.

Umno leaders are convinced that the prospect of defections by PR state lawmakers is becoming more of a reality which will force the PAS-led Kedah government to hand over the reins either through its own collapse or state elections.

The confidence was expressed amid a backdrop of a growing uneasiness in the PR camp.

PAS Mentri Besar Datuk Seri Azizan Abdul Razak (picture) had recently said that it would dissolve the state assembly if one more defection takes place.

His statement was backed by Kedah PKR chief Datuk Johari Abdul who told The Malaysian Insider that BN has been “intensely approaching” PR lawmakers, particularly PKR’s, recently in a bid to “buy them over”.

BN needs just three more seats to form the new government after PR saw two of its lawmakers quitting the party recently to become independents.

“I see possibilities of a few PR lawmakers defecting. I see this because there are many who are dissatisfied with the party’s leadership,” Kedah Umno secretary Datuk Nawawi Ahmad told The Malaysian Insider.

It is understood that Umno expects two to three lawmakers to defect soon. Nawawi, however, did not divulge the names of the lawmakers who are purportedly unhappy with their parties and are ready to jump.

PR in Kedah holds 20 of the 36 seats in the state assembly. PAS leads the pact with 16 seats while PKR holds three. DAP has a sole representative in the state legislature.

Nawawi said should two more PR lawmakers defect, it would mean both PR and BN would have 18 seats each and this would force the state government to call for fresh elections.

“But if three of them defect, we would have one extra seat and would form a simple majority just as what had happened in Perak,” added the Umno man.

PR leaders in Kedah, however, are adamant that the defection scenario is unlikely.

“I have heard of this rumour of defections for so long up to the point of Umno lawmakers discussing on who will become the next MB. But I am not shaken by this. If it happens, I will dissolve the state assembly and we let the voters decide,” said Azizan.

Johari also expressed confidence that the defections will not take place.

“We have received reports about this. The MB is very well aware of it as all of those who have been approached by BN have reported this to him. It is impossible that it will happen,” he told The Malaysian Insider.

BN has 14 seats while the two independents, Mohammad Radzhi Salleh of Lunas and Tan Wei Shu of Bakar Arang, are tipped to be “pro-BN”.

The status of one of the BN’s 14 seats, Kota Siputeh, is still under the review of the courts after Speaker Datuk Dr Abdul Isa Ismail decided to vacate the seat held by Umno’s Datuk Abu Hasan Sarif after he allegedly failed to attend the state assembly for two consecutive sittings.

Companies can only hire Malaysians as security guards in future

Government has decided to impose that only Malaysians can be hired as security guards in near future. According to Human Resource Minister Dr S Subramaniam, the decision is meant to open up more job opportunities for the locals.

Currently, the total of foreign guards in the country hiked up to around 4,000 with majority of them from neighbouring countries such as Nepal, Indonesia and Philippines. In an effort to encourage locals to apply for security guards position, a pay hike for those employed in private sector would take place from July 1.

Hence, Subramaniam wanted the security companies to comply and adapt with the new rules.

Penang opposition leader faces censure over May 13 warning

Opposition leader Datuk Azhar Ibrahim will be referred to the Rights and Privileges Committee for uttering seditious words after the Penang state assembly passed a motion here today.

There was pandemonium in the assembly today when opposition leader Azhar warned that there would be a repeat of the May 13 riots if the people lost confidence in the authorities.

Speaker Datuk Abdul Halim Hussain who had instructed Azhar to retract his statement, later approved the motion and said a notice of the motion would be sent to Azhar.

Commenting on public criticism over the police shooting of teenager Aminulrasyid Amzah, Azhar said that the army can take over from the police if the police do not enjoy public support.

His comment was followed by scores of demands from Pakatan Rakyat assemblymen for Azhar to withdraw his statement, but the latter refused, forcing Jagdeep Singh Deo (DAP-Datok Kramat) to propose that Azhar be referred to the Rights and Privileges committee.

Meanwhile, Azhar when met said he was ready to face any eventuality or concerned with any action taken against him.

“I spoke in that manner after Umno and Barisan Nasional (BN) were labelled as corrupt, autocratic and I am willing to face anyone, even in court,” he told reporters.

The assembly, into its fourth day, was already abuzz with a heated argument between Penang Chief Minister Lim Guan Eng and Azhar before the decision.

The argument, which lasted for about 30 minutes, started when Lim (DAP-Air Putih) was winding up debate on a motion of thanks to the Yang Dipertua Negeri Tun Abdul Rahman Abbas.

Azhar (BN-Penaga) said since the Pakatan Rakyat-led state government did not recognise the police force, he had suggested that the army should take over the duties of ensuring law and order in the country.

Lim said DAP only deemed that Tan Sri Musa Hassan was not fit to be the Federal Police Chief and that did not mean DAP does not respect the police force or their services.

“It is not wrong for us to criticise Musa Hassan (Tan Sri) because to us, he is not eligible to be the police chief. The latest issue of police shooting and killing a 15-year-old, Aminulrasyid (Amzah) is another case in point,” he said.

Meanwhile, to another question by Azahar, Lim said the government awarded Taiyo (KL) Resorts Sdn Bhd the tender to manage the Bukit Jambul Golf Club because the company had offered a high price that would benefit the state government.

“Although it is a foreign based company, the deal will benefit the state government,” said Lim when answering Azhar who wanted to know why the tender was not awarded to a local company. — Bernama

Lim said Khalid and Musa’s statements – made within 48 hours of the shooting death by the police — had resulted in an inaccurate portrayal of Aminulrasyid by the media, claiming that this was also the reason why the Cabinet failed to offer a timely message of condolence to the boy’s family.

“The first question that comes to mind for Malaysians is why the Cabinet did not express its distress and condolences at last Wednesday’s Cabinet meeting, which met more than 48 hours after the fatal shooting and killing of Aminulrasyid.

“Is it because the Cabinet had relied on the first public account of the heinous police killing by the Selangor police chief Datuk Khalid Abu Bakar who said Aminulrasyid was shot dead ‘while reversing his car in an attempt to run over several policemen’, describing the Form 3 student as a ‘criminal’?” said Lim in an statement issued today.

According to the Ipoh Timur MP, Khalid’s initial statements had distorted the details of the shooting by claiming that the police had opened fire because “a male passenger jumped out and escaped on foot while the driver reversed his car and tried to run over the policemen.”

Khalid then said one of the policemen fired four shots at the tyres of the car but one of the bullets was believed to have hit the boy, killing him instantly. He also added that police found a parang inside the car, which is believed to have been used in robberies.

“The Inspector-General of Police Tan Sri Musa Hassan also publicly endorsed and joined in Khalid’s trial by media of Aminulrasyid in painting the Form 3 student as a criminal — with the insinuation that the parang in the car had been used in robberies!

“Musa even compounded the trial by media against Aminulrasyid by publicly postulating that ‘a speeding vehicle which can be used to plough into policemen is also a dangerous weapon,’ which could endanger the lives of enforcement officers and other road users.

“The clear picture emerging in the past ten days is eye-witness account that Aminulrasyid was fleeing for home and had never tried to reverse to ram policemen to justify the firing of over 15 shots, one of which hit him at the back of his head and killed him while driving the car, causing the vehicle to crash into a tree, a retaining wall and into a drain!”Lim said.

Lim demanded that the IGP and the Selangor CPO apologise to Aminulrasyid’s family, as well as the main witness in the case, Azamuddin Omar, for falsely describing them as criminals. He went on to note that the Cabinet had already expressed its “distress and condolences” to the bereaved family.

Lim said that failure of the police as well as Home Minister Datuk Seri Hishamuddin Hussein in carrying out a “fair, independent and professional investigation into Aminulrasyid’s killing” had resulted in the police investigation papers, which were submitted to the Attorney-General’s Chambers last Friday, being remitted back to the police the same evening for further investigations.

“Aminulrasyid’s killing had been classified under ‘murder’ in police investigations but the IGP is asking for an inquest. This is most extraordinary for it could only mean that as of now Musa rejects any charge of murder or homicide against the police personnel concerned!”

The MCA leadership also came under fire from Lim, for siding with the IGP and the Selangor CPO despite rising anger over Aminulrasyid’s death.

Lim categorised MCA liaison bureau chief, Datuk Ti Lian Ker’s attack on Azamuddin’s character a few days ago as proof of MCA’s “silence and subservience” when Musa and Khalid had cast aspersions on Aminulrayid and Azamuddin following the shooting.

Azamuddin has given a statement that refutes the police version of the incident which claim Aminulrasyid had tried to reverse the car towards the policemen. He also alleged he was assaulted by the police when he tried to surrender.

Policemen re-enacted what transpired in the 2am incident on Monday, and Musa was shown, among others, a tree that was hit and a section of a house wall where the car, Aminul was driving, stopped after he was shot.

Musa said investigation papers into the incident were submitted to the Attorney General this morning.

"The report has been completed.

"Today, we are investigating whether the policemen's actions were justified," he said.

"I hope there would be an open inquiry into the matter so this could be investigated thoroughly. The police force also want to see justice done for Aminul."

Musa said a friend of the car owner and a motorcyclist, grazed by Aminul on Monday night before he was shot, had also lodged police reports.

"Their reports are vital in assisting police investigations," he said. The Malay Mail learnt the motorcyclist suffered leg and hand injuries after his machine was hit by the car, believed to have been driven by Aminul.

Musa, however, declined to reveal more details as the incident was still undergoing investigation which would be brought to court. Musa said he was saddened by the tragedy.

"I am sad as it involved a young civilian but this happened at 2am in an area that experienced frequent break- ins."

He said this aroused the suspicions of policemen involved on that fatal day.

"However, as I said earlier, we also want to see justice served. Don't take it as if I'm protecting my men. Right now, we should focus on the investigation and whether the actions of the policemen were justified."

Musa said he had been suggesting to the government to equip patrol cars with video cameras to record events.

"Unfortunately, this could not be done due to insufficient funds," he said.

Musa also pleaded for the public not to speculate and politicise the issue.

"Don't listen to speculations. We also want to be fair to everybody. So let's be fair in this (case)."

Who is doing the speculating? Us or the police? First the police said the car reversed at them, then a witness said the car didn't. Then the police said there was a parang & the witness said there wasn't. Maybe the police should keep quiet instead of giving information which appears to be speculation instead of evidence?

The shooting of a teen is one thing but what is troubling is the finding of a machete in the trunk - if news reports were to be accurate. Discharging one's firearm is not the only issue here but the public is also concern that offensive weapons could be planted by rogue police personnel. Are there inspections done to police cars before they go on patrol to ensure that policemen do not carry along things they are not supposed to. As in the case of the shooting in Seremban some years ago in front of a disco where the civilian arms bearer shot another patron over parking space. In that case the perpetrator quickly contacted his friend who is an ASP in the police force and what do you know.......... a knife was found.

The public could not help but suspect that the knife was planted as if to excuse that the shooter acted in self-defense. Still the court found him guilty and he was sentenced to hang. Videos and cams in police cars are one thing but are inspections done to ensure that no cops carry offensive weapons just in case it is needed to substantiate their actions when shootings occur? I am sure there are many honest and serving police personnel but some are likely to be questionable as well. It is important for the public to have faith in the police and for this sake, the police must also be reassuring.

Aminul's Facebook group attracts almost 60,000

Support for Facebook group "Kami Benci Kekejaman Polis Malaysia!- Justice for Aminulrasyid" (We Hate Malaysian Police Brutality!), set up last week, has ballooned to over 58,000 supporters from across the country as of this morning.

When it was first created, the group attracted 3,500 supporters, which grew to over 10,000 in a matter of hours.

Postings on the Facebook page stated the group was set up to show support and to express disappointment over the police's action against the 15-year-old.


The unknown creator of the group insisted it was not set up to oppose or insult the police force. Group members included Aminulrasyid's friends, school teachers, journalists, activists, as well as other members of the public.

Over 170 discussion topics were created to discuss the incident and video postings of Press conferences given by Aminulrasyid's family were also uploaded.

Among the most discussed topic in the group was "Laporan polis sahabat arwah Aminulrasyid - wajib baca!" (Late Aminulrasyid's friend's police reports - must read!) where 254 comments were recorded.

So far, 276 photos were put up by supporters. These included pictures allegedly taken during the night of the incident and pictures of the victim before the tragedy.

As much as i agree that the police has to do it's job, their actions aren't really justified. For goodness sake, i didn't hear that this guy was armed or that he attacked the police or shot at them for whatever reasons,..he only sped off {i guess} out of fear and i bet if he was caught and scolded and adviced or even given a light punishment, he would surely learn his lessons,...shooting an unarmed person who never showed any sign of hostility except that he sped off is really uncalled for,...that's just too bad and unfair. While growing up as adolesents, most of us can remember a couple of crazy or wierd things we might have done which we weren't scolded for and if we were caught, we were scolded and turned a new leaf. so unfortunate he wasn't given a second chance,..just too bad.

The people are worried by the police being trigger-happy because we do not want to have a situation of shoot first and ask questions later.The shooting death of the teenager was unfortunate but under the circumstances, the police had no idea who the driver was. It could have been anybody. But why shoot to kill? That is the disturbing issue of the tragedy. In this situation it is no point being defensive and emotional. When an innocent man was shot by police in London during the aftermath of the underground train bombing in London in 2007, the Police Chief took responsibility and resigned. That somehow allayed the peoples' frustration. In Malaysia his counterpart is scoring points with the angry people, so do we wonder by the facebook set up for the dead teenager drawing so many followers? Ministers, please send top government officers to centres of excellence in the world and learn how to handle situations like this!

Police bring key witness to scene of fatal schoolboy-shooting

Azamuddin Omar relived the nightmare of seeing his friend shot dead, when he helped investigators including a police forensic team last night piece together the final moments of Aminulrasyid Amzah’s life.

Fadiah Nadwa Fikri, one of three lawyers with Azamuddin, told The Malaysian Insider they met investigators at the Selangor police headquarters at 9.20pm before the 15-year-old retraced the route driven by his friend in the early hours of April 26.

Azamuddin was in the car with the 14-year-old schoolboy who was shot dead by police, and is regarded as a key witness in the case.

Besides retracing the route, Azamuddin repeated his account of what transpired that night.

He pointed out where police had opened fire, where his friend was shot in the head, and where the car crashed into a drain and where he was assaulted by policemen.

“His account tonight was consistent with what he told police earlier and what he had said during a press conference on Monday,” said Fadiah.

Previously, Azamuddin had said his friend was scared and only wanted to return home because he was driving his sister’s car before police opened fire.

He had recounted how Aminulrasyid was shot in the back of the head, how his friend’s body slumped into his lap and how the car kept moving forward because the dead schoolboy’s foot was still on the accelerator.

He made no mention about Aminulrasyid trying to reverse the car to ram policemen, contradicting police claims of what had transpired.

Azamuddin also alleged he was kicked in the head and assaulted by no fewer than five policemen, before he escaped.

Fadiah yesterday said police concluded their investigations at the scene before 11pm.

“It went on smoothly and the police involved were reasonable and cooperative.”

Azamuddin was earlier questioned for a third time at the Selangor police headquarters yesterday evening.

His lawyers were subsequently informed by police that the Attorney-General had wanted Azamuddin to return to the scene with police last night.

“I was told that the AG had ordered police to wrap up their investigations by tonight.” said lawyer N. Surendran yesterday.

MCA hits back at Hishammuddin and Ahmad Maslan for making them the scapegoat

Loh Seng Kok, the deputy chief of publicity of the MCA said that the party should not be made the scapegoat and that they should not be blamed for the drop in Chinese votes in the recent Hulu-Selangor by-election. This came in the wake of the statements made by Datuk Seri Hishammuddin Tun Hussein, the vice-president of Umno and Datuk Ahmad Maslan, the party’s information chief who called on the MCA to prove itself to the Chinese community. Loh said "As Umno is a major party in the coalition, it should be statesman-like, practicing decorum in its effort to work together with MCA. MCA would not deny that it had internal problems. The party was taking steps to review and improve itself but irresponsible and controversial statements would only affect BN's image”

Kelantan Sultan's wife in hospital to evade police

The Raja Perempuan Kelantan Tengku Anis Tengku Abdul Hamid (pic) has been holed up at a hospital here since last night to evade police arrest and to be by the side of her husband, the Sultan of Kelantan, Tuanku Ismail Petra, who was reportedly forcibly warded there.

She told The Malay Mail by telephone this morning that the Sultan was being held against his will and that the police had ignored his orders to take him back to the palace.

Tengku Anis, who spent most the night on the floor outside Royal Ward on Level 8 of the Universiti Sains Malaysia hospital, later managed to enter the ward and lock herself in.

Meanwhile, the Sultan's lawyers, Datuk Mohamed Haaziq Pillay and Gobind Singh Deo, arrived here this morning to seek the Sultan's release from hospital.

Haaziq said they will file a habeas corpus writ in the Kuala Lumpur High Court if they fail to get their client's release.

Tengku Anis, relating her ordeal last night, claimed that the police had allegedly abused her and "pulled me like a cow" in an attempt to take her to the police station last night.

She said in the incident about 7.45pm last night outside the Istana Mahkota in Kubang Kerian, heavily armed police's Special Action Squad (UTK) personnel in balaclavas stopped the entourage accompanying the Sultan to the Ismail Petra Airport in Pengkalan Chepa.

They were on their way to the airport in a second attempt yesterday to send the ruler for follow-up treatment in Singapore.

"We were all so frightened when the police confronted us," said Tengku Anis.

"UTK personnel stormed our car and forcibly tried to remove my husband which resulted in a scuffle.

"My husband kept telling me that he wanted to return to the palace, but they (police) whisked him away to the Universiti Sains Malaysia hospital.

"They dragged me out of the vehicle and pushed me all over the place, including at the hospital, when they shoved me into the lift as my husband was being taken to the ward."

She said she spent the night on the floor outside the royal ward. "They would not allow me to be with my husband despite my pleas that I fear for his safety.

"Furthermore, if I leave the hospital, they will arrest me."

"Asked why police wanted to quiz her, she said: "I don't know... I just don't know..."

Meanwhile, Tengku Temenggong, Tengku Muhammad Fakhry, told The Malay Mail after being freed last night from a police station, that they did not inform him why he was being questioned.

He was at the police station for more than four hours, during which, police recorded his details without specifying why he was being held in the first place.

Tengku Fakhry, 32, said he also feared for his father's safety and that the family is looking at ways to be by his side.

He confirmed that his handgun and that of his bodyguard's were seized by the police at the palace earlier.

Police were not available for comment but sources said that the seizure of the weapons could be linked to the shooting of a palace guard by an unknown man at Kampung Sungai Nyior, Tumpat, early last Saturday.

The guard, Ramli Mohamed, 50, is being treated at the intensive care unit of the Hospital Raja Perempuan Zainab II here.

Tengku Fakhry said he find it difficult to understand why he had to be quizzed about a Press conference, an hour before detention, on the failure to send the Sultan to Singapore for medical check-up.

He had told reporters then that the charted aircraft to fly the Sultan to the republic was refused permission to land at the airport here, adding that the airport authorities issued the order to ban it from landing and picking up the ruler. It was scheduled to take off at 11.30am.


Following this, Tengku Fakhry had arranged to take his father on a commercial flight to the KLIA in Sepang and subsequently on another flight to Singapore.

The Sultan returned two months ago from a nine-month treatment for a heart ailment at the Mount Elizabeth Hospital in Singapore.

Besides Tengku Fakhry, police also detained the Sultan's two doctors, a physiotherapist and eight bodyguards. Till lunch time, they were still at the police station.

The doctors were identified as Kolonel Dr Mohamed Razin Kamarulzaman and Dr Lim Choon Hai, and the physiotherapist as Roslin Ngah.

Tengku Fakhry had been involved in a battle with his elder brother, the Regent of Kelantan, Tengku Muhammad Faris, after the former was dropped from the State Succession Council.

Last March, the ruler's private secretary, Datuk Wan Hashim Wan Daud, was briefly held by police over a statement that the Regent had been removed from his post.

KUALA LUMPUR: Police believe the attempted murder on a Kelantan palace guard last Friday was part of a conspiracy to assassinate Kelantan Regent Tengku Muhammad Faris Ismail Petra.

The Malay Mail was informed that it was for this reason that police detained the Regent's younger brother, Tengku Temenggong Kelantan Tengku Muhammad Fakhry, and his bodyguards outside Istana Mahkota in Kubang Kerian about 7.30pm yesterday.

Muhammad Fakhry and his bodyguards were released later but police seized firearms found on them.

The Malay Mail was also informed that investigations into the shooting of 50-year-old palace guard,Ramli Mohamed, revealed that he was targeted as he knew of the alleged assassination plot.

The former soldier was shot in the chest by two men in the midnight incident as he was riding home on his motorcycle near Tumpat after completing his shift. He is being treated at a hospital in Kota Baru.

The country’s renowned lawyer, Karpal Singh will be representing the family of Aminulrasyid Amzah, the 14 year old who was shot by the police in an incident recently. Karpal will be handling all the legal matters pertaining to the death of Aminulrasyid which will include writing to the AG (Attorney-General) to conduct a thorough investigation on the death of the 14 year old. Showing to the media his appointment letter, he said "The family has appointed me to take the necessary action." He also said that he is open to any assistance in reference to N Surendran, the lawyer who has been speaking on behalf of the family since the incident happened where Aminulrasyid was alleged to have tried to reverse his car towards the policemen who tried to stop him.

On Facebook, boy’s death sparks war of words

The shooting death of Aminulrasyid Amzah has sparked off a fierce war on Facebook between groups for the teenager and for the police.

Since the incident, these two groups have been abuzz with activity as the “fans” in support of Aminulrasyid are demanding that the policemen who shot him be investigated and punished.

The group supporting the police — the”Kelab Penyokong Polis DiRaja Malaysia” (Malaysian Police Supporters Club) — has risen to defend the men in blue, driving home the point of the various “sacrifices made by the police”.

“This is the attitude of people who forget where they come from, ungrateful... if the police were to not exercise their duties, our country would be in a state of chaos... don’t be rude to our police, respect them. They work day and night to maintain peace... the devils are using this case as a political tool... the world recognises the good work that our police can do,” said a wall post on the police supporters’ club.

The club, although created around the same time as the justice for Aminulrasyid page, currently only has over 6,000 fans. In contrast, the Aminulrasyid page has more than 60,000 fans.

Public anger against the police has steadily risen over the past week.

The pro-police group’s aims are focused on reminding people of the importance of the police force as an institution, and how it needs to be upheld and not insulted and ridiculed.

“These are the faces that have worked hard to make sure that the people in this country sleep peaceful... do not insult the police as if they have not done anything for our country, please don’t be emotional when commenting... be humans not animals,” said a caption below the pictures of Inspector-General of Police Tan Sri Musa Hassan and his men posted on the fan page.

The administrators of the fan page, who remain unnamed, also expressed anger at DAP lawmaker Karpal Singh for being appointed Aminulrasyid’s family’s legal counsel.

“We the admin are shocked to hear that the mother of the late Aminul agreed to appoint Karpal Singh as the lawyer.

“Yesterday the mother stated and begged for politicians not to intervene in this case. Has the family forgotten that Karpal is a politician? There are so many more qualified lawyers to choose from, it’s just that we are slightly disappointed,” said the posting.

Both groups are equally aggressive in their tenacity to carry their message across.

Comments on the pro-Aminulrasyid page also contained strong language against the policemen for firing the fatal shot at Aminulrasyid and urged the policemen involved to come forward to assist in the investigations.

“Al-Fatihah to brother Aminul, those who are responsible, if you are really guilty please admit your guilt and apologise openly so that his soul can rest in peace. You may escape punishment from this world but what about the afterlife later on? Maybe there was a misunderstanding when it happened, but there’s no need for hiding the truth just to absolve yourself from guilt. Remember that the Almighty knows everything that happens,” said a posting.

The police supporters’ page has also been attacked by Facebook users who share similar views as Aminulrasyid’s fans.

“Hey what’s the point of this page, if you want to shoot as you please leave the name of Allah and Muhammad on that police badge. Islam never taught its people to kill for cheap thrills, especially innocent children,” read another posting.

According to initial reports, the Form Three student was shot in the head when he tried to reverse his car into four policemen after a high-speed chase, just 100 metres from his home in Section 11, Shah Alam last Monday.

Police also reportedly shot the tyres of the Proton Iswara to stop the vehicle during the incident.

A parang was also reportedly found in the car but this account has been disputed by witnesses and the family.

Aminulrasyid’s friend, who was in the car with him, came forward yesterday to deny the police version of events.

He denied his friend had tried to reverse the car to ram the policemen.

DAP questions need for nuke power

Penang Chief Minister Lim Guan Eng has asked the government to reconsider its decision to build a nuclear plant, as the country already has a high energy reserve of 40 per cent.

The DAP secretary-general questioned the necessity of the nuclear plant as Malaysia only requires a 20 per cent energy reserve.

“Malaysians are waiting to be convinced of the economic rationale of a nuclear power plant,” Lim said in a statement issued today.

Energy, Green Technology and Water Minister Peter Chin announced yesterday that the government has approved a nuclear power plant, which will start operating from 2021.

It is the first country in Southeast Asia to announce a nuclear power plant, a sensitive matter in the Asean grouping that has always espoused a nuclear-free zone. Malaysia now relies on a combination of fossil fuels and hydro-power to generate electricity.

Lim noted that Chin said a nuclear plant was needed to meet the country’s increasing demand for energy due to industrialisation, and to ensure energy security with 20 per cent power reserves.

“However, Malaysia’s current reserve margin is double that at 40 per cent, with the current power usage at 14,000MW with a capacity of 23,000MW.

“Further, the proposed RM 15 billion Bakun Dam producing 2,400MW and RM 5 billion Murun Dam producing 900MW, both in Sarawak, will more than meet any increased demand. Clearly, Malaysia has more energy than it needs. Without any economic grounds or energy security justification, why then does Malaysia need a nuclear power plant?” he said.

Lim then queried whether the government would be able to address the safety and environment concerns in order for the project to proceed.

“Further, Malaysians wonder what assurances can be given in relation to safety and environment following the 1986 Chernobyl nuclear plant accident in Ukraine that claimed 56 lives and resulted in 4,000 cancer deaths.

“Unless these environmental and safety concerns are addressed, there is also no economic logic and necessity for building a nuclear power plant in 2021 in a yet to be identified location in Malaysia,” he added.

Chin said his ministry has been given the go-ahead by the Economic Council to start identifying suitable sites but declined to reveal possible sites or the total power to be delivered.

According to Energy Commission’s (Suruhanjaya Tenaga) interim report on the performance of the electricity supply, peninsular Malaysia’s maximum demand was 14,007MW from the installed generation capacity of 19,723MW in 2008.

In the first quarter of 2009, maximum demand was 13,330MW with a capacity of 21,117MW. In the second quarter, maximum demand rose to 14,029 MW.

In East Malaysia and in the same quarter, Sabah’s demand was 704MW from a capacity of 835MW, while Sarawak’s demand was 913MW from 1,237MW output.

Why not explore the wind or solar energy? we have long sea shore, many mountain and have sun thru out the year. Wecould tap on the wind energy along the sea shore and on the mountain where the mother nature give the "resources" free to us. The sun is always shining in Malaysia.
The environmental effect of using these "free" natural resources will be very minimum (we may talk about turbine that created magnatic field or the battery use for solar energy storage may post some environmental problem)compare to nuclear energy. Knowing our government or civil department are famous for having 1st class facility with 3rd class mentality and maintainance ability, if we have a neuclear plant the history of Chernobyl is in the making!!!

It should be tax free to encourage people to use the solar energy for their home and even factory. Unethical for Aminulrasyid’s friend to give his account of incident in public while probe still on

Selangor Police Chief Deputy Datuk Khalid Abu Bakar has called the move to get the friend of Aminulurasyid Amzah, who was shot by police in an incident last week to tell his version of the incident was unethical and that it was a cheap publicity stunt to get public sympathy. He said that revealing versions of the story in public with investigations still underway is not the right way and that it would be seen as tampering with evidence. He said “The lawyer’s action in holding a press conference and exposing the boy, a key witness in this case, was a cheap publicity stunt to garner public sympathy while investigations were still under way. The boy has made some very serious allegations about the incident. Exposing him will only put more pressure on him, besides confusing the public. The case has yet to be brought to court. The very people who are supposed to know the law are clearly and cleverly attempting to create a situation,”

Tan Sri Musa Hassan, the IGP (Inspector General of Police) said that “The Attorney-General’s Chambers had returned the investigation papers on the incident. They had been instructed to investigate certain matters and hoped to complete their investigations as soon as possible.Critics should be mature enough to differentiate truth from speculation. Regardless of what they say about us, it is our duty to keep the country safe,”

Nik Aziz asks PM to retract statement

Kelantan Mentri Besar Datuk Nik Abdul Aziz Nik Mat today asked Prime Minister Datuk Seri Najib Razak to retract his recent statement that he (Nik Aziz) had defied an order and insulted the Sultan of Selangor in regard to political speeches in mosques.

The PAS spiritual leader said the statement by Najib, which was published in a mainstream newspaper on April 25, was a viewpoint aimed at pitting him against the Selangor palace.

He also alleged that the newspaper concerned had fabricated news a day earlier that he had questioned the Sultan’s decree which forbade mosques from being used for political purposes.

“I will not forgive this here or in the hereafter unless Najib openly retracts what he said,” he said in a posting on his blog today.

Sultan Sharafuddin Idris Shah of Selangor had issued the order which is binding on mosques in Selangor in the interest of preserving Muslim solidarity.

Nik Abdul Aziz denied he had ever questioned the Sultan’s order. He was in Hulu Selangor helping the Pakatan’s campaign for the by-election in the parliamentary constituency when the issue surfaced.

“I never gave any response that touched on the Sultan’s directive. It was an outright fabrication by the newspaper concerned,” he added. — Bernama

Lack of press freedom in Malaysia

















In conjunction with the World Press Freedom Day on 3 May, approximately 30 people sat at KLCC park and read the newspapers upside down. The activity that was held yesterday afternoon lasted for 15 minutes.

Shoppers and tourists were baffled with their actions to read the newspapers upside down. Those who participated in the event sat on the stairs along the way to the park. According to chairman of Writers Alliance for Media Independence (WAMI), Wong Chin Huat said their actions were meant to convey that there is a lack of press freedom in the country.

Hence, by reading the newspapers upside down, they were keen to imply that there is a lack of press freedom in the newspapers. Wong said they do not intend to highlight any particular media in Malaysia.

He stressed that people can decide and observe the various media channels in Malaysia. Thus, media have to improve on the professional standards.

Portion of ceiling at Penang state assembly collapsed

It is reported that a portion of the ceiling in the Penang State Assembly sitting hall collapsed yesterday. Fortunately, no casualties were reported. According to speaker Abdul Halim Hussain, the ceiling over the media and at the public galleries collapsed around 3.30 pm yesterday.

Even though there were two to three staffs in the hall when the incident occurred, he said no one was injured. Meanwhile, Public Works Department is currently delving into the incident and checking on the safety of the building.

Initially, the state assembly is planned on Monday but Abdul Halim assured that the sitting will continue as scheduled. On another note, similar incident happened three years ago on July 23, 2008 when part of the plaster ceiling in the very same building tumbled down.
