Datuk Seri Nazri Aziz wants a royal commission of inquiry (RCI) to be set up to determine whether an act of prostitution took place in the recently-released sex video that allegedly features Datuk Seri Anwar Ibrahim.

The minister in the Prime Minister’s Department said the RCI was also needed to determine whether or not the man in the video was the de facto opposition leader. Anwar has denied he is the man in the grainy 21-minute black-and-white video clip, first shown on March 21 to selected journalists.

“Prostitution is illegal in Malaysia. If you participate, or you are aiding and abetting in prostitution, if you patronise prostitutes for sex, this is a crime.

“The RCI would be to determine the identity of the man in the video and of the woman he was having sex with, whether she was a prostitute,” Nazri told The Malaysian Insider today.

But section 372 (1) of the Penal Code states that it is only a crime if a person “sells, lets for hire... procures, buys or hires or otherwise obtains possession of” any person with the intention of employing, or using that same person for the purpose of prostitution.

The section states that it is also a crime to utilise “deceitful means” to assist in bringing a person in Malaysia for the purpose of prostitution.

Sections 372a and 372b state that it is a crime to live off the earnings of the prostitution of another person and it is also against the law to solicit for the purpose of prostitution.

The Penal Code does not say that it is illegal for an individual to engage in sex with a prostitute in Malaysia.

“There is a moral issue here. Anwar aspires to be prime minister of Malaysia… we cannot have a tainted prime minister, that is why we need to identify the person in the video… if it is Anwar, what would you think of him?” said Nazri.



Elaborating further, the minister said today an RCI on the sex video was necessary to satisfy public interest.

“If the public is satisfied with the findings, then there would be no need for the RCI. But if there is an element of doubt, then RCI is needed.

“RCI is needed for anything of public interest, to clear up any issue of public interest,” Nazri said.

But the de facto law minister cautioned that the RCI would only be needed if the public was not satisfied with the findings of the ongoing police investigations.

“We have to first wait for the police to complete investigations, to identify the man in the video,” he said.

He said the Cabinet had decided to allow the police to complete the investigations first before pushing for an RCI.
Two weeks ago, a mysterious “Datuk T” had screened a video purportedly showing Anwar having sex with an unidentified woman.

Former Malacca Chief Minister Tan Sri Abdul Rahim Thamby Chik, businessman Datuk Shazryl Eskay Abdullah and Perkasa treasurer-general Datuk Shuib Lazim then claimed responsibility for the video, saying they screened the video to show “a man who wants to be prime minister is not qualified.”

A 107-second snippet surfaced on the Internet on Sunday, just two days after police said the video was not doctored.

It made public part of the video that was only screened to select individuals and reporters prior to this but the clip has since been taken down from YouTube for violating the video site’s policy on nudity and sexual content.

PKR has claimed that the clip proved the man in the video was not their de facto leader and repeated their demand that the trio be arrested for pornography.

When asked whether the “Datuk T” trio should be the ones charged for committing a crime, Nazri quickly responded by saying that that was a “separate issue.”

“If the three people committed the offence, that will be up to the police to decide on after they wrap up their investigations,” said the veteran Umno MP.

DAP lawmaker and veteran lawyer Karpal Singh said recently that the “Datuk T” trio could be charged under section 292 of the Penal Code and section 5 of the Film Censorship Act for allegedly distributing obscene material as well as criminal defamation and criminal intimidation.

That is a 1st in the world! Having a RCI to determine if prostitution has taken place. If they ever find the lady in the video, I hope she sues them for defamation for calling her a prostitute where there's no proof!

It seems that to BN/UMNO, whether the prostitution take place or not is more important than the following:

1. whether the law had been broken by Datuk T
2. whether Najib involved in Altantunya case
3. whether there is a kick back in Military purchase and why did we pay a significant huge amount (which is few time higher) than other countries to get the same weapon
4. whether the current Sarawak chief (Taib) really involved in the allege corruption and amass a huge wealth for him and his family

else, why no RCI propsed for the above?


I am going to send all malaysian sex video to Nazri to allow him to determine whether each sexual act was done with a prostitute...i think the government can establish a Royal Commission Inquiry of Sexual Act in Malaysia, chaired by Nazri himself :)....ha ha ha ha ha.....
