Eskay wanted revenge on Anwar, says Megat Junid’s ex-bodyguard

A retired policeman said today that Datuk Shazryl Eskay Abdullah had told him that he would bring down Datuk Seri Anwar Ibrahim before the video allegedly showing the opposition leader having sex with a Chinese prostitute surfaced on Monday.

Mohamad Mahti Abdul Rahim, who was the late Tan Sri Megat Junid Megat Ayub’s bodyguard, said that Shazryl had been angry with the Permatang Pauh MP for not wanting to testify in a civil suit he had filed.

“After that he started talking angrily about Anwar. He began to talk bad about him, saying ‘I will bring down Datuk Seri Anwar, whatever it takes,” he said.

Mohamad Mahti himself had agreed to be a witness in the suit where Shazryl is claiming he was owed a RM20 million commission for securing the deal for the RM460 million “crooked bridge” between Singapore and Johor.

He said that when he had testified in the case on March 8, Shazryl had begun badmouthing Anwar when court was in recess and continued to do so after that day.

“Whether this tape is real or not I don’t know, but he wanted to bring down Anwar Ibrahim. He said Anwar stole money from him,” he said.

Former Malacca chief minister Tan Sri Abdul Rahim Thamby Chik had admitted on Wednesday that Shazryl, Perkasa treasurer-general Datuk Shuib Lazim and himself were collectively the mysterious “Datuk T” behind the 21-minute sex video that was screened on Monday.

Mohamad Mahti said today that Shazryl had also met him before last weekend to ask for help to secure former special action unit (UTK) officers, ostensibly for protection when he screened the video.

“He asked me to help him find four former UTK officers. When he said it was to attack Datuk Seri Anwar, I told him I didn’t want to know anything at all,” he said.

Mohamad Mahti, who had worked for the former domestic trade and consumer affairs for 18 years, said that he did not want to be involved despite having known Shazryl since 1996.

However, he said he followed Shazryl to Shuib’s home where he found out that the Perkasa man was an advisor at Shazryl’s fertiliser factory and that he would soon be made chairman.

“There, Eskay started saying he was doing this for No. 1,” he said, adding that Shuib seemed hesitant to help Shazryl.

“I don’t know who it is and I did not ask him who he meant,” Mohamad Mahti said when asked if Shazryl was referring to Prime Minister Datuk Seri Najib Razak, who Anwar has accused of being involved in the release of the video.

“But now that all these accusations have happened, I feel I need to reveal the truth. Datuk “SK” is for Si Kitol,” he said, referring to the character in Malay history who betrayed the Sultan of Malacca to the Portuguese for his own benefit.

Mohamad Mahti, 53, said that he first met Shazryl when the latter was a physiotherapist for the Badminton Association of Malaysia (BAM) in the 1990s.

“Datuk Megat had a muscle tear and Shazryl was recommended to me, so I introduced him to Datuk Megat,” he explained.

“But when Datuk Megat had cancer and even when he passed away, Eskay never once visited him,” he said.

He said that this was also how Shazryl was introduced to then prime minister Tun Dr Mahathir Mohamad and Anwar, as his services was also recommended to them.

Mohamed Mahti said that Shazryl had also met him on January 17 and told him he now operated five fertiliser factories in Thailand.

He said that Shazryl had become close to Abdul Rahim because he was the chairman of the Rubber Industry Smallholders Development Authority (RISDA) and Shuib because he was the father-in-law of Rural and Regional Development Minister, Datuk Seri Shafie Apdal.

“He was also trying to get close to Felcra chairman Datuk Tajuddin Rahman so that he can secure deals to sell the fertiliser,” he said.

He said he was given RM5,000 as “pocket money commission” to arrange a meeting with the Pasir Salak MP.

Mohamad Mahti said that a month later, Shazryl gave him a handwritten note allegedly written by Shazryl, promising various officers, including Tajuddin, a cut of every tonne of fertiliser sold via Federal Land Consolidation and Rehabilitation Authority.

“I felt that this was bribery so I SMSed Tajuddin to forget the whole thing,” he said while showing reporters the alleged note written in red ink.

The former cop said that one of Anwar’s bodyguards, named Mokhtar, had called him earlier this week to ask why Shazryl was doing this as he had just brought his whole family to visit the PKR de facto leader a few weeks ago.

“I told him I knew nothing about the video until after it was released this week.

“Eskay is a liar. Everything he has said is a lie,” he told reporters at his goat farm here this afternoon.

“I am available if the police or even the Malaysian Anti-Corruption Commission want to question me. If Eskay wants to sue me, go ahead. I have no worries,” he said.

Mohamad Mahti added that Shazryl said he had helped Anwar a lot and brought the former deputy prime minister to Singapore to do a DNA test to disprove allegations in the late 1990s that he was the father of PKR deputy president Azmin Ali’s daughter.

He said that Shazryl also claimed to have helped Anwar send controversial blogger Raja Petra Kamaruddin to the UK when he was recently wanted for criminal defamation and sedition.

He added that he was not being asked by anyone to make these claims, pointing out that “if I was paid, we would hold the press conference in an air-conditioned hotel.”

Shazryl and Abdul Rahim have been detained by police earlier today in relation to the sex video.

Anwar has denied that he is the man in the video, claiming that it is a political attack by Barisan Nasional.

The black-and-white video was allegedly taken on February 21 at a hotel room in Kuala Lumpur.

It begins with footage showing a man the trio claim to be Anwar, a woman with East Asian features and another unidentified man in the room.

The second part, recorded from four slightly different angles, showed the man receiving oral sex from the woman and then having sexual intercourse with her in several positions.

Pakatan says sex video will backfire on Umno



Pakatan Rakyat (PR) leaders predicted a backlash today for Umno after Tan Sri Abdul Rahim Tamby Chik admitted that businessman Datuk Shazryl Eskay, Perkasa’s Datuk Shuib Lazim, and himself were behind Monday’s screening of a sex video allegedly featuring Datuk Seri Anwar Ibrahim.

The sex video scandal surfaced early on Monday when a mysterious “Datuk T”, had shown to journalists a black-and-white video of a man performing sexual acts with a woman of apparently East Asian origin in a hotel room, dated February 21.

The PKR de facto leader had since came out to deny that he was the man in the video, backed by his wife, Datuk Seri Dr Wan Azizah Wan Ismail as well as his fellow opposition leaders.

Anwar had later pointed the finger at Home Minister Datuk Seri Hishammuddin Hussein and Prime Minister Datuk Seri Najib Razak for conspiring against him.

Today, opposition leaders jumped on the fact that the trio was linked to Umno, calling it a political attack to distract voters from “real issues”.

Selangor DAP vice chairman, Charles Santiago told The Malaysian Insider that it came as no surprise that the people behind the screening of the video are linked to Umno.

“From day one, people knew it was Umno, it’s just that people didn’t know which faction of Umno it was coming from and so it was obvious that this was the Mahathir faction that seems to be involved in this episode.

“I think it’s an overkill and I think there is going to be a backlash,” he said.

PAS Shah Alam MP, Khalid Samad, said that this fiasco was “clearly politically motivated” when there are former Umno leaders actively involved.

“It was done purely to make sure Anwar is out of the picture and it will backfire on them.

“I think basically we just have to say that they are going to go all out to create the perception that Anwar is a sex-crazy individual who has no control over his sexual desire,” he said.

Abdul Rahim is a former Malacca chief minister who was charged with statutory rape of a minor in 1994, but the public prosecutor later withdrew the charge citing lack of evidence. He is now the chairman of RISDA.

Shazryl was known to be formerly in Anwar’s inner circle. He is currently the plaintiff in the case that was filed in January 2002, claiming a breach of contract by Merong Mahawangsa Sdn Bhd and Datuk Yahya A. Jalil — for failing to pay him RM20 million after he had procured the Johor crooked bridge project for them.

Perkasa treasurer, Shuib, was a former Sungai Petani Umno division leader, and is Umno vice-president Datuk Seri Mohd. Shafie Apdal’s father-in-law.

PKR communications director, Nik Nazmi, said that the continuous political attack against its de facto leader was getting tiresome.

“This is to show that Anwar is morally incapable and a hypocrite, although you don’t know what the pattern is, whether he is gay, a womaniser or a member of the Muslim Brotherhood.

“This shows that what we are saying, made up to smear Anwar, as he is seen to be the biggest threat to Umno” he said.

He said that people were getting tired of such political ploys.

Santiago said that today was a “great day” for the opposition because there was “ample proof now that this has been doctored” and this is a propaganda tool of the “desperate Umno boys because only desperados will do something like this”.

“If you want to knock off your opponent, it is through policy debates, it’s through various development policies and so on, that you outsmart the other guy there. That’s the advantage that you bring but here you want to be a sleazeball and by doing this, you think people are going to support you. People will not because they voted for a prime minister, they vote for an opposition leader, they don’t vote for the best husbands in the world, or the best fathers in the world.

“As a voter, you vote for the candidate that you think will bring about change in the government, that will bring about progress for the people, development for the people. That’s who people vote for, not for sleazeballs,” he said.

At Datuk Seri Anwar Ibrahim’s home last night, former Abim president Datuk Siddiq Fadhil gave an impassioned sermon to a 400-strong crowd of mostly Muslims.

But a quick survey of the compound saw more than half of the men clad in robes or baju Melayus absorbed in reading a chronological account of events in the sex video saga where Anwar is allegedly shown having sex with a prostitute.

Curiosity, especially within the Malay public, has been piqued and this is viewed positively by Pakatan Rakyat (PR), who will be holding a series of rallies in the coming week that will see it go on the offensive, accusing Umno of gutter politics.

“The sex video is shrouded in doubt. This has opened the way for us to reach the public, especially the Malays who want to find out more,” PKR secretary-general Saifuddin Nasution told ...

Last night, Anwar held prayers at his home and had catered for 250 Muslims to come for a night of sermons, but the opposition leader later had to apologise to the 400 who came for being ill-prepared for the crowd.

If the video is — as PR claims — an Umno ploy, then it may well backfire as pact now appear to have been galvanised.

Anwar is in his element when under siege and issues quickly become platforms for the PKR de facto leader, as was seen when tens of thousands protested his 1998 sacking as deputy prime minister.

His party has responded swiftly to seize the initiative since the video first surfaced on Monday, alleging Prime Minister Datuk Seri Najib Razak’s involvement with the trio, collectively known as “Datuk T”, behind the 21-minute tape.

PKR’s claims of dirty politics by Umno has gained credence when Tan Sri Abdul Rahim Thamby Chik, who had to resign in 1994 as Malacca chief minister after accusations of statutory rape, admitted that he was part of “Datuk T.”

Umno, too, has seen the potential damage and has been quick to distance itself from its former Youth chief, insisting that Abdul Rahim was acting in his personal capacity.

Significantly, even PAS now seems to be firmly by Anwar’s side after talk of uneasiness with PKR following a string of by-election defeats in Malay-majority seats.

When a reporter asked Anwar on Tuesday if he should swear on the Quran that he was not the man in a sex video that surfaced the day before, it was PAS president Datuk Seri Abdul Hadi Awang who insisted on fielding the question.

In a sermon that night in Taman Medan, Petaling Jaya, he spent over 20 minutes of a fiery speech claiming that the ruling Barisan Nasional (BN) was indulging in gutter politics to bring down Opposition Leader Anwar, who is also facing an ongoing sodomy trial.

According to Saifuddin, the ceramah drew a crowd of 5,000 — over 20 per cent more than expected.

“Yes, we’ve noticed that Hadi has become very fierce since the video came out,” said former PAS secretary-general Datuk Kamaruddin Jaafar.

Abdul Hadi has been seen as being cool about his Islamic party’s relationship with Anwar, unlike the “Erdogan” camp in PAS that is said to support the embattled PKR de facto leader at all cost.

Anwar finding an unexpected champion in Abdul Hadi to fight the latest allegation of sexual misconduct is the clearest sign that the opposition coalition still has plenty of puff left in it.

Azmin’s sister, Ummi Hafilda, who has accused Anwar of sexual misconduct over the past 13 years, has claimed that there are 18 more sex videos of the Permatang Pauh MP.

But as Badrul Hisham Baharin, a PKR Youth leader, put it last night, “They can have 188 more sex videos and it would not matter.”

AND AT LAST the trio had to reveal themselves for who they actually are. It is indeed a tribute to Dato' Seri Anwar Ibrahim's team who had no problems identifying these UMNO-sponsored personas barely 24 hours after they 'shook' the world with a sex tape which, in my opinion, has less steam than Chua Soi Lek's escapades.

Nazri Aziz's response in an interview with Malaysiakini TV showed the irresponsible side of him though he is a self-proclaimed 'knowledgable lawyer'.

His statement that Anwar should 'stop preaching morality when his own morale is questionable' cannot in any way be attributed to a person well read in Law. He presumes that as Anwar has been faced with many sex allegations, surely one of them is true, clearly demonstrates this excuse of a Law Minister on how he perceives the concept of justice.

If his distorted logic were to be taken as a rule, surely Rahim Tamby Chik, Jamaludin Jarjis and even Najib Razak himself should be found guilty due to multiplicity of accusations. I fear if one day BN decides to appoint him as a Federal Court Judge.

Back to the topic in question, these 3 stooges clearly have violated section 292 of the Penal Code, and referring to the statement of the current Inspector General of Police who have classified it as being investigated under that section I have to congratulate him for not being a pawn of BN and UMNO.

Now that refers to culpability under the civil law. In Islamic Law the trio has committed Qadzf, - or slanderous accusation of adultery. Clearly Muslim drunkards and sex offenders feel that there is no need to substantiate their actions by referring to Islamic Syari'ah sources. And it is amazing that neither JAWI nor JAIS see the public screening of pornography as a religious offence, they would rather debate on whether bibles are forbidden to christians themselves or not.

If UMNO is indeed as religious as the heights of their songkok claims to be, then it would follow that they would conform to Islamic Law, and not merely those parts of Islamic Law which may accord them political mileage!

In any event kudos to PKR investigators for quickly identifying the trio and forcing them to reveal their identities unwillingly. It proves that Anwar's circle of influence is more far-reaching than Najib's and this is a major concern for UMNO. These mules will continuously feed information to Anwar and with UMNO's weaknesses known, Pakatan Rakyat will walk to Putrajaya in the grandest of fashion.

IGP says will probe ‘everyone’ connected to sex video scandal



Inspector-General of Police Tan Sri Ismail Omar has promised to leave no stone unturned in the probe into a sex video allegedly of Datuk Seri Anwar Ibrahim having sex with an unidentified woman.

Ismail said today that the police had formed a “special team” and will bring in and question anyone necessary.

“We will question and probe not only those believed to be behind the video, but anyone who can help us with the investigation,” said Ismail.

The IGP however was tight-lipped when asked to confirm rumours that the police had received the said sex video.

He also chose to neither confirm or deny that the “Datuk T” trio — Tan Sri Abdul Rahim Tamby Chik, businessman Datuk Shazryl Eskay, and Perkasa’s Datuk Shuib Lazim would be brought in for questioning.

“I don’t want to say anything yet... it might be premature at this point... we have not received any report from the team yet.

“Please do not speculate and give a chance to the special team to conduct the investigations,” Ismail told reporters.

Abdul Rahim and Shazryl admitted yesterday that they were collectively the mysterious “Datuk T” behind Monday’s screening of a sex video purportedly featuring Anwar.

The former Malacca chief minister also admitted that both he and Shazryl were involved.

He told reporters at a joint press conference together with Shazryl that the trio had chosen to step forward on their own accord because they wanted to show that “a person with high ambitions of wanting to be national leader and prime minister of Malaysia ... was not qualified.”

Abdul Rahim and Shazryl both denied the video was doctored.

Ismail said today that the special team was led by the Bukit Aman CID chief and senior officers of the Kuala Lumpur police headquarters.

Anwar claimed revenge had motivated Abdul Rahim towards orchestrating a sex tape scandal implicating the opposition leader.

“The involvement of Rahim Tamby Chik reminds me of his old case and old grudge... of his rape accusations and case where the prosecution papers were signed by (Attorney General Tan Sri) Gani Patail that he was involved with a bribery issue.

In 1994, Abdul Rahim had been charged with statutory rape involving a minor. Although the charge was later dropped by authorities, who cited insufficient evidence, the scandal had cost Abdul Rahim his political career.

“He’s doing this out of revenge,” Anwar said today.

Anwar, who turns 64 in August, was freed from jail in 2004 and is seen as the glue that binds the PKR-PAS-DAP pact.

He had played a key role in forming a viable opposition coalition in the run-up to the landmark 2008 general election when the three main opposition parties denied BN its traditional two-thirds control of Parliament.

The fledgling three-party coalition also won control over four other states — Kedah, Penang, Perak and Selangor — in addition to maintaining Kelantan in the 12th General Election.

PAS president Datuk Seri Abdul Hadi Awang had slammed the video which showed a man resembling a senior Malay opposition leader engaged in sex with a woman said to be prostitute.

Abdul Hadi had called it a dirty political move coming ahead of the Sarawak state elections.

A former deputy prime minister from 1993 to 1998, Anwar filed a police report denying he was the man recorded.

The father of six who is standing trial for sodomy with a former male aide has accused Prime Minister Datuk Seri Najib Razak and Home Minister Datuk Seri Hishammuddin Hussein of being involved in the video-recording, which Anwar said was an attack on him and PR.

Alleged sex video handed to Bukit Aman

The former Malacca chief minister said he gave the police the original copy of the recording so they could determine its authenticity.

“(The video) can be examined forensically to see if it’s a fake or has been doctored,” he told reporters outside Bukit Aman here.

“We can call on experts, even from the FBI (Federal Bureau of Investigation) in America, to determine the video’s authenticity.”

Rahim said he hoped the police could speed up investigations as it was important for the Malaysian people to know the identity of the “actor” in the video.

He added that he had also handed over the Omega watch allegedly belonging to Anwar as further proof of the identity of the man in the sex video.

“Although [Anwar] did not confess (to owning the watch), forensics experts will certainly see the watch as an important piece of evidence,” he said.

Rahim had been questioned at the Royal Malaysian Police (PDRM) headquarters for nearly five hours from 5.00pm to 9.45pm.

Datuk Shazryl Eskay Abdullah, who also claimed responsibility for the sex video, gave his statement at around the same time but did not meet with reporters afterwards.

Perkasa treasurer-general Datuk Shuib Lazim, the third person involved in the sex video, is expected to give his statement tomorrow morning when he returns from a trip.

Rahim, Shazryl Eskay and Shuib — known collectively as “Datuk T” — had screened the video to senior editors and journalists on Monday in a bid to force Anwar to quit politics.

Rahim told reporters at a joint press conference with Shazryl Eskay yesterday that they had wanted to show that “a person who wants to be national leader and PM... was not qualified.”

The former Umno vice president had also urged Putrajaya to set up a royal commission to investigate the authenticity of the video.

He said the royal commission’s members should comprise opposition lawmakers, and named Anwar’s wife and PKR president, Datuk Seri Dr Wan Azizah Wan Ismail, as foremost on the list.

Perkasa Youth chief Arman Azha Abu Hanifah also claimed that Shuib was acting in his personal capacity and not as a member of the Malay rights group.

But Arman Azha was quick to defend Shuib for his involvement, reasoning that the “pornstar” in the video was more sinful than the people who exposed the act.

Johari denies asking for bribes, disputes sex video location

PKR MP Datuk Johari Abdul today discredited several claims made by “Datuk T”, including him soliciting bribes and the hotel location of Datuk Seri Anwar Ibrahim’s alleged sex video.

The Sungai Petani MP denied that he had ever attempted to seek gratification from “Datuk T”, namely Tan Sri Abdul Rahim Tamby Chik and Datuk Shazryl Eskay, in exchange for his defection from PKR upon watching the video last week.

Instead, he said he had barely spoken during the screening as he had been wary of the likelihood that he was being filmed.

“You think I am stupid? I did not speak much during the screening. All I did was to ask things like where, why and who.

“When I walked into the room, I knew that I could be walking into a trap,” he told a press conference today.

Johari also alleged that it was Abdul Rahim who had openly assured him that his financial needs would be taken care of, after the video screening.

“After I saw the video, I did not say yes or no. I knew that if I said it, it will be used against me.

“Rahim was polite to me all the way and called me ‘Datuk’ when he addressed me. He said, ‘Datuk, we have seen this video and Anwar’s court case is nearing its end. Then this will come up. So let us settle this. I can bring you to meet with the Prime Minister and we will take care of your financial needs and security’.

“I just kept quiet and smiled,” Johari recalled.

The former Umno man also denied that he had ever said he believed the man in the 21-minute long black-and-white video was Anwar.

In a press conference yesterday by Abdul Rahim and Shazryl, the latter had said that when Johari walked into the room at the Flamingo Hotel in Ampang he had immediately said, “That’s him (Anwar).”

He also claimed that Johari had demanded RM1 million per person to draw seven PKR MPs with him to cross over to Umno.

But Johari rebutted the claim today and added that all of Shazryl’s and Abdul Rahim’s assertions yesterday had been manufactured in a harried manner as a cover-up to their lies regarding the tape.

For one, Johari voiced doubt that the video had been filmed at a local hotel.

“Shazryl kept telling me at the time about how worried he was that the Thai authorities would use this clip to hold Anwar ransom in the future when he becomes the Prime Minister.

“He kept mentioned Thai authorities, saying that he was sure they would already have many such similar clips,” he explained.

He said that he was confused over Shazryl’s fixation with Thailand and had asked the latter to explain it.

“I asked him, where is this hotel? Then he said it is in Kuala Lumpur... but why worry about the Thai authorities then? But I did not ask more because I did not want to talk much,” he said.

Johari later said that the hotel could likely have been in Thailand and the man in the video could have been Shazryl himself.

“After all... Eskay (Shazryl) kept saying that he is the man in the video. What does he mean? This opens up a new dimension.

“Is he the man behind the video, the protaganist, or is he the main actor? After all, he looks like Anwar too,” he said.

Johari recalled that during the first few seconds of the video, he had seen three characters in the tiny, dingy-looking hotel room - a fully-dressed man, another man only wearing a towel and a fully-naked woman.

“There are two possibilities... He could be the man who was dressed, or the one in the towel. But even if he was the man who was dressed, what was he doing in the room?” he said.

He added that he was “100 per cent certain” that the entire fiasco was a conspiracy masterminded by the top Umno leadership.

“There is no doubt about it. 100 per cent.

“Rahim must have already been given the green light to go ahead with this. He would have discussed this with the top leadership,” he said.

Johari added that since the target of the video was to frame Anwar, the perpetrators behind the clip would have been well aware that the entire conspiracy needed to be well thought out.

“This is Anwar. You have to think things through carefully because the political implications are not just local but international.

“Also, why did they choose to screen it to editors and reporters? Because they would then write bad things about Anwar? Why not screen it to taxi drivers, fishermen or farmers?

“Then why screen it in Carcosa? Under such tight security? Like they are unveiling some secret nuclear weapon... this means that this is a conspiracy to pressure the leader.... to show that first, he (Anwar) is tried for sodomising a man and then now he is having sex with a woman... this is to show that Anwar is one hell of a man,” he said.

The sex video was first screened to reporters and editors in a cloak-and-dagger fashion at the prestigious Carcosa Seri Negara hotel in Kuala Lumpur on Monday.

Shazryl aka Datuk T offered to get crooked bridge deal, says contractor



Executive director and major of shareholder Merong Mahawangsa, Datuk Yahya A. Jalil (picture), denied today that he sought help from Datuk Shazryl Eskay Abdullah and told the High Court that the plaintiff had voluntarily offered his services instead.

Shazryl, the plaintiff in the case, had filed the suit in January 2002, claiming a breach of contract by defendants — Merong Mahawangsa Sdn Bhd and Yahya — for failing to pay him RM20 million after he had procured the rights to the Malaysia-Singapore International Gateway (SIG) bridge project.

He was also named today as one of three persons behind the mysterious entity “Datuk T” who had screened a sex video allegedly featuring Datuk Seri Anwar Ibrahim.

Shazryl had earlier testified that, in addition to approaching the late Tan Sri Megat Junid Megat Ayub for help, he had also helped Yahya gain access to then-deputy prime minister, Anwar.

Yahya admitted today to having a casual meeting with Anwar at the former minister’s house with Shazryl in 1998 but couldn’t recollect discussing the bridge.

“I cannot remember if I brought this blueprint (Malaysia-Singapore International Gateway) to Anwar,” he said.

“The purpose of meeting him was because Datuk Shazryl Eskay said he was able to help,” he added.

Yahya added that he could not remember if he had promised 16.6 per cent of shares in Merong Mahawangsa to Shazryl.

He also denied that he had requested help from Shazryl for access to foreign funding for the project.

He also did not agree that Shazryl had helped him in the letters to Anwar, Megat Junid and Economic Planning Unit (EPU) on the SIG project.

However, Yahya agreed that his company, Gerbang Perdana Sdn Bhd, was paid RM155 million by the government for the Gerbang Selatan Bersepadu (GSB) project in Bukit Chagar, Johor Bahru — the new location of the customs, immigration and quarantine complex.

But Yahya was quick to stress that GSB was different from SIG bridge project.

He also acknowledged to not paying the RM20 million agreed to Shazryl as the conditions were not met in the letter of undertaking.

According to the letter, the agreement is void if the project is withdrawn or no longer “sustainable.”

Plaintiff’s counsel Datuk C.V Prabhakaran argued that the SIG was mutually terminated and that Merong Mahawangsa had received compensation.

Gerbang Perdana’s financial director, Azhar Abdul Aziz, later testified to explain that the SIG and GSB are two different projects — the former was a privatisation exercise while the latter a design-build, turnkey contract.

“The SIG is a bridge from Johor to Singapore but the plan was discarded in 2001 and Tun Dr Mahathir Mohamad had instructed it be changed in its entirety,” said Azhar.

Azhar added that the bridge was changed into a crooked bridge to the existing causeway.

In his statement of claim, Shazryl Eskay said Yahya, executive director and major shareholder of Merong Mahawangsa, had enlisted his help to procure the project from the government and to secure RM640 million in foreign funds for the project.

Shazryl claimed the second defendant had sought his help for his “discretion and good relations” with the government.

Shazryl Eskay said the second defendant suggested RM20 million in remunerations for his services, which has not been paid.

The “crooked bridge” project was terminated by the Abdullah administration in 2006.

Shazryl Eskay is seeking a RM20 million payment from the defendants as well as interest, costs and other relief deemed fit by the court.

Judge Justice V.T. Singham has set April 13 for both counsels to submit their written submissions and March 5 for the decision.

Abdul Rahim also said that PKR Sungai Petani MP Datuk Johari Abdul had demanded money to defect after the latter was shown the video on Monday afternoon.

The former Malacca CM also urged Putrajaya to set up a royal commission to investigate the authenticity of the video.

Johari had suggested earlier today that businessman Shazryl was the mysterious “Datuk T”, and that Abdul Rahim was among those behind the screening of a sex video.

Johari also accused the two men of attempting to entice him and other PKR MPs to defect after he had viewed the recording, which he said was of a person who only vaguely resembled Anwar.

According to Johari, Abdul Rahim had also promised to bring him to see Prime Minister Datuk Seri Najib Razak after he had viewed the sex video.

Anwar has already accused Najib of being directly involved with the screening of the sex video.

Hisham: Special police unit to probe sex video




A special unit will be formed to investigate a police report lodged by Datuk Seri Anwar Ibrahim over the emergence of a sex video allegedly featuring him, Datuk Seri Hishammuddin Hussein said today.

“This unit will communicate directly with the Inspector-General of Police. I have instructed the IGP to be more professional, transparent and thorough in this investigation,” the home minister was quoted as saying by national news agency Bernama.

Hishammuddin (picture) said the case would be brought to the Bukit Aman police headquarters as it was a high-profile case and involved public interest.

Anwar, his wife and numerous other Pakatan Rakyat lawmakers have since denied the authenticity of the clip.

The PKR de facto leader has instead trained his guns on Hishammuddin and Prime Minister Datuk Seri Najib Razak, accusing them of being involved with the video screening that allegedly shows him having sex with an unidentified woman.

Both the PM and the home minister had yesterday denied any involvement of the police and Home Ministry over the emergence of the sex video.

“He can accuse anyone but in the end all we want is the truth,” said Hishammuddin today.

IGP Tan Sri Ismail Omar also confirmed today that police have begun investigations into Anwar’s police report.

Ismail said the case was being investigated under section 292 of the Penal Code under possession and distribution of pornographic material.

The IGP said he had received Anwar’s police report but refused to elaborate.

During yesterday’s screening to selected media personnel at a prominent hotel here, the unidentified man had promised to surrender a copy of the video to Anwar and his wife Datin Seri Dr Wan Azizah Wan Ismail next Monday.

This, he had said, was to enable the duo to identify the man in the video and subsequently to announce their resignations.

Despite deciding not to surrender the video to Anwar and Wan Azizah, Datuk T pledged to stick to his promise that the recordings will be kept away from the hands of the authorities.

This, he predicted, was because any police involvement would likely invite further denials from Anwar.

Datuk T first emerged yesterday to reveal the video recording of a man resembling Anwar engaging in sex acts with a woman, believed to be a prostitute from China.

According to Datuk T, the video was taken on February 21 from closed-circuit television camera recordings found in a hotel room in Kuala Lumpur.

The black-and-white video was shown in several parts, beginning with the politician, a woman with East Asian features, and another unidentified man in a hotel room.

The second part, recorded from four slightly different angles, showed the man receiving oral sex from the woman and then having sexual intercourse with her in several positions.

This is not been the first time the opposition leader has been accused of having affairs, but analysts say the latest accusation might prove to be the breaking point for the federal opposition.

Anwar was sacked as deputy prime minister in 1998 and charged and convicted of sodomy. He spent six years in prison before the country’s top court overturned the conviction in 2004.

After his release, Anwar led his PKR, DAP and PAS to record gains in Election 2008, denying Barisan Nasional (BN) its traditional two-thirds parliamentary majority and cemented the three parties’ status as serious challengers for power with the formation of the PR pact.

But he was arrested later the same year and charged again in court on another sodomy accusation involving a former male aide, a charge he has denied.

So far Anwar has remained defiant in the face of the latest scandal, and despite the bleak outlook his supporters point out that he has made at least one improbable comeback in his career after he was jailed and could still do so.

“Now that Datuk Seri Anwar Ibrahim has lodged a police report denying that he is the man in a sex video screened to media personnel on Monday, I presume that he and his wife are not interested to receive a copy of the recording from me next Monday.

“Therefore I am calling on the media fraternity and NGOs to immediately form an independent public commission to investigate the authenticity of the tape,” he wrote.

The commission, he said, would also be allowed to engage foreign experts from any country to verify the recording.

“I will hand over the original recording to the public commission. I will also hand over the Omega watch that was found in the room where Anwar was caught on video with a foreign prostitute.

“The commission can send the watch to forensic experts to find if DNA found on the watch matched Anwar’s,” he said.

Barisan Nasional (BN) leaders denied today that the ruling coalition was behind the emergence of a sex video purportedly showing a senior Malay opposition politician in a sex act with a woman.

The BN men also questioned Pakatan Rakyat’s (PR) defensive posture over allegations that the man in the sex video was a senior leader of the opposition.

BN Youth chief Khairy Jamaluddin asked why PR had swiftly denied that the man shown was Datuk Seri Anwar Ibrahim, when none of their leaders had even seen the clip.

“It seems very strange that Pakatan politicians are very quick to deny especially since none of them have seen it. Since it was only made available to journalists this morning. How do they know? Nik Nazmi was very quick to tweet that it was not Anwar.

“It was him saying that it was not Anwar, we from BN never said it was Anwar. We did not mention any names, but they seem very defensive about this. Maybe there is something there but I do not want to speculate,” the Rembau lawmaker told reporters in Parliament today.

PR has been quick to accuse BN of being behind the video, claiming that the ruling coalition had become desperate by shifting from major issues to personal attacks.

Minister in the Prime Minister’s Department Datuk Seri Nazri Abdul Aziz dismissed PR’s allegations and said BN was often made a scapegoat for the opposition pact’s problems.

“Anything that involves BN MPs is a fact but anything that concerns them is a conspiracy. Make up your mind. Who is right or wrong? I think the public is clever now,” said the Padang Rengas MP.

Defence Minister Datuk Seri Zahid Hamidi added that the federal opposition was suffering from denial syndrome.

“Well you know as the opposition, they are making comments on anything. They belong to a group called denial syndrome group,” said the Bagan Datuk MP.

While denying BN involvement, Kinabatangan MP Datuk Bung Mokhtar Radin also called for a police investigation into the sex tape.

“We are not playing up the issue and the government is not responsible for the video. How true is the video? We will let the police investigate on who is involved.

“I think it is not good if Umno or BN is involved but individuals and NGOs, we cannot stop them from spreading the videos but they have to face the risks,” he said.

Kota Belud MP Datuk Abdul Rahman Dahlan urged leaders from both sides of the divide to not aggravate the situation further unless the speculation is confirmed.

“I think people should calm down. There have been a lot of speculations. I’ve not seen the video. I’m not saying it’s true, but I think we should take a step and calm down, look at it rationally.

“If it’s true then it’s bad, if it’s not true, it’s also bad. Either way, we have to wait for the truth,” he said.

He also said that the public should refrain from making comments over the matter on social media outlets such as Twitter and Facebook.

“I would like to advise everybody, and I have been refraining from commenting about it on Twitter or Facebook because I think this issue is a very grave issue and it involves a very prominent leader of our country. He is a family man so it’s very personal.

“People have been poking me (on Facebook), asking me questions but I didn’t tweet about it. Everyone must calm down, as it’s a big issue,” he said.

Datuk Seri Anwar Ibrahim denied today that he was the man filmed having sex with a woman in a hotel room on February 21, and called the emergence of the video recording today a “scurrilous attack” against him, his family and Pakatan Rakyat (PR).

“Yes, I deny sternly this scurrilous attack, I categorically deny it,” he told reporters this evening when asked point-blank if he was the man in the video recording.

He added that he was at home with his wife, Datuk Seri Wan Azizah Wan Ismail, their children, grandchildren and members of his staff, on the night in question.

Anwar was speaking at a press conference called after a video recording showing a man resembling a senior Malay opposition leader having sex with a woman believed to be a prostitute from China emerged today.

“I was told the face in the video looked like me. However, the stomach of the man was much bigger than mine,” he said while showing reporters his abdomen.

The 21-minute-long recording was shown to members of the media this morning by a man who only identified himself as “Datuk T”.

“Datuk T” said that the February 21 video, which was timestamped from 10.23pm to 10.44pm, was from closed-circuit television camera recordings found in a hotel room in Kuala Lumpur.

This evening, Anwar called the video an attempt to stunt the progress of PR and himself.

“Don’t drag the public and the country into this dirty politics.

“The media screening this morning was arranged with such care. The screening was also held for senior mainstream media editors first, guarded by the elite Special Branch.

“I do not know who is ‘Datuk T’, who asked me and Azizah to resign. This shows clear political motive,” he said, referring Dr Wan Azizah, the PKR president.

He claimed the sex video had come as the sodomy charge against him was faltering

“I call for Pakatan Rakyat and the public in general not to be distracted by this new allegation but to concentrate on the battle in Sarawak so we can end the corrupt government of (Tan Sri) Abdul Taib Mahmud,” he said of the Sarawak chief minister.

The Sarawak state assembly was dissolved today, paving way for state polls next month.

The PKR de facto leader also said that he had been posting on Twitter, a social media platform, at the time of the alleged event and that PKR had kept a record of his tweets on the day.

PKR staff said that Anwar would lodge a police report in Kuala Lumpur tomorrow morning.

Sex tape hits Parliament lounge




A video recording purportedly showing a senior Malay opposition leader having sex with a suspected prostitute, was screened in the MP's lounge in Parliament hours after being shown to members of the media earlier this morning.

Sources told The Malaysian Insider the video was played on a laptop belonging to a Parliament official, in the smoking area of the lounge, and seen by several Barisan Nasional (BN) lawmakers and reporters from an Umno-owned online news portal.

The 21-minute-long recording was shown to members of the media this morning by a man who only identified himself as “Datuk T”.

“Datuk T” said that the February 21 video was from closed-circuit television camera recordings found in a hotel room in Kuala Lumpur.

The black-and-white video was shown in several parts, beginning with the politician, a woman with East Asian features, and another unidentified man in a hotel room.

Anwar said that while there was facial resemblance, he and the man in the video were of different body types.

Gebeng plant a ‘time bomb’




Environmental groups renewed calls this week to stop work on the RM700 million rare earth plant in Gebeng, Kuantan.

Against the backdrop of the on-going nuclear plant crisis in Japan which was triggered by the huge earthquake last week, the NGOs said that the refinery will generate radioactive waste that “brings back memories of Bukit Merah,” where a rare earth plant set up in the 1980s has been linked to at least eight leukaemia cases, seven resulting in death.

“As we are observing now in Japan, the waste is a sitting time bomb,” said Environmental Protection Society of Malaysia (EPSM) president Nithi Nesadurai.

Local residents who formed Kuantan Environmental Watch Group (KEWG), an umbrella body for community stakeholders in the Pahang capital, have begun distributing articles and pictures of the crippled Fukushima Daiichi nuclear plant as a warning to fellow residents of the possible disaster.

“If Japan, which is known for its safety record and technology, can’t avert disaster, how about us with our inexperience?” spokesman Jonathan Wong said.

The massive earthquake in Japan last Friday and the resulting explosions at nuclear power plants have fuelled fears about the plant in Malaysia’s east coast which faces the Pacific Rim’s ring of fire.

The 9.0-magnitude earthquake sent a 10-metre-high tsunami surging into cities and villages, sweeping away everything in its path.



Australian mining company Lynas Corporation has insisted that the rare earth ore to be refined in Gebeng has only two per cent of the radioactive element thorium that was present in the raw material used in Bukit Merah.

The Bukit Merah plant, set up in 1985, was also subject to sustained protests by local residents. It is still undergoing a massive cleanup operation that will cost RM300 million, nearly two decades after the plant was shut down.

But Lynas has already begun construction of the rare earth refinery in Prime Minister Datuk Seri Najib Razak’s home state of Pahang where the opposition Pakatan Rakyat (PR) is planning to drum up the issue ahead of a general election expected to take place within the year.

Lynas expects to begin refining the rare earth metals, used in such high-technology products as smartphones, hybrid cars and even bombs, by the end of next year in an operation that may be worth over RM5 billion in the first year, increasing to RM8 billion in the next.

Last week, Lynas told The Malaysian Insider that it is planning to reprocess the waste into a cement mixture for road-building with approved levels of thorium, although it has not finalised details.

However, the environmentalists contacted were unanimous in their demand that work be halted until all issues had been addressed, expressing a lack of confidence that the government would have the political will to withhold approval should the plant not meet safety standards.

“After Lynas has spent RM700 million to build the plant, is the government really going to say no? We are very cautious of any assurance being given as we’re heard it all before when the Asian Rare Earth plant was being built in Bukit Merah,” Nithi said.

“We have heard no solution at all to dealing with the waste. We want to know what it is before Lynas starts operations, not just assurances that they will manage it,” Wong, a founding member of KEWG, told The Malaysian Insider.

He claimed that since the project was first mooted in 2007, Lynas has only met the residents once in late 2008 and did not respond at all to the question of waste disposal.

Malaysian Nature Society communications head Andrew Sebastian said it had sent Lynas a letter expressing its concerns and questions after the 2008 meeting.

“Our only comment is that we received no answer and we continue to have the same doubts,” he said, referring to various concerns including waste disposal and radiation released in the refining process.

Dr Jayabalan A. Thambyappa, who treated radiation victims linked to the Bukit Merah rare earth plant, also said that the public briefing did not address waste disposal.

The toxicologist told that NGOs such as the Consumer Association of Penang and Sahabat Alam Malaysia, of which he is a member, have and will continue to oppose to refinery.

For an Australian company like Lynas to set up a plant that will endanger the future generations of Malaysians is very hypocritical of them. EC says impotent in Kampung Baru referendum



The Election Commission (EC) has no authority to hold a referendum on the proposed redevelopment of Kampung Baru as suggested by its residents, said the commission’s chairman Tan Sri Abdul Aziz Mohd Yusof yesterday.

On Friday, the Kampung Baru Malay Agricultural Settlement Administrative Board (MAS) had made the call for a referendum to poll landowners on their stand on Putrajaya’s plans to redevelop the Malay settlement in the capital city, just a stone’s throw away from the world’s tallest twin towers.

Its honorary secretary, Shamsuri Suradi, had said the EC was the ideal body to carry out such a vote as it was seen to be impartial.

But Abdul Aziz has now said the EC lacked the legal authority to do so.

Aziz said it was not the EC’s place to conduct the direct vote.
“There is no provision in the federal constitution and Election Commission Act for the EC to hold any kind of referendum. The EC is an independent body under the constitution and cannot be involved in such cases as a Kampung Baru referendum,” the EC chief wrote in an SMS to The Malaysian Insider.

Parliament is expected to debate a new bill in June to regulate development in the 111-year-old settlement, where it is hemmed in by newer buildings including the Petronas Twin Towers built over the last two decades.

In an interview with The Malaysian Insider, Shamsuri had said that the government should hold the vote to avoid bickering among co-owners of landlots who may support certain political parties, now that the issue has been taken up by politicians.

However, he admitted that a referendum would not be an easy process as it may take up to
a year to complete.




The Kampung Baru Development Bill was delayed until June to allow the draft to be reviewed following the protest of landowners and heirs.

The bill, initially scheduled to be debated in Parliament this month, would have opened the way for a new body to replace MAS and give the minister in charge, full authority and immunity from legal proceedings with regards to developing the Malay enclave.

Most of the land in the settlement is under multiple ownership due to Islamic inheritance laws and cost a fraction of the land across the Klang River.

Residents are making a spectacle of their opposition towards the development plans.
There are more than 4,000 Kampung Baru landowners spread across seven villages in the settlement measuring 90.2 hectares.

Kampung Baru lies within the Titiwangsa federal constituency, which has always been an Umno fortress but fell to PAS in Election 2008.

Pakatan Rakyat has been quick to capitalise on the growing anger of residents unhappy with the Najib administration’s plans to develop the area into an icon of Malay ownership in the heart of Kuala Lumpur.

Several landowners have already put up banners opposing the new law or plans to redevelop the settlement, which has an LRT station and is popular among tourists and city residents as a street cuisine spot.

Prime Minister Datuk Seri Najib Razak kick-started the redevelopment of Kampung Baru by getting a RM20 million allocation recently to renovate the iconic Masjid Jamek in the middle of the settlement.
