Declare Batu seat vacant! Ibrahim Ali

Datuk Ibrahim Ali, the Independent Member of Parliament has urged the EC (Election Commission) to declare the Batu parliamentary seat vacant. The seat is held by PKR (Parti Keadilan Rakyat)’s Tian Chua who was recently sentenced to a fine of RM2,000 for an incident where he bit a policeman 3 years ago. The High Court judge had earlier ruled for a fine of RM3,000 but reviewed it and reduced it to RM2,000 to avoid another by-election.

Ibrahim said “The judge is required to make decisions only on law and not to avoid by-elections. That’s not his role according to the doctrine of separation of powers. It was inappropriate for Tian Chua, who is PKR strategic director, to continue to be a lawmaker when he has been convicted of breaking the law by hurting a policeman.” According to Article 48 of the Federal Constitution, “An MP should be disqualified from his seat if he is fined not less than RM2 000 or sentenced to not less than a one-year jail term for an offence.”
