The Home Ministry wants all concerns, complaints and necessary evidence on the April 28 rally to be directed to the independent advisory panel to enable it to come up with a conclusive picture of what occurred before, during and after the gathering.

Its minister, Datuk Seri Hishammuddin Hussein, said the recommendations on the rally made by the six-man panel headed by former inspector-general of police Tun Hanif Omar would be a collective decision of the panel, and not based on the individual itself.

“I hope the panel members would be accorded all necessary support and encouragement to carry out their duties, which is to paint a true picture of the rally riots, without any undue pressure and distraction,” he said in a statement here today.

The government on Wednesday announced the appointment of panel members to gather actual details on the riots in Kuala Lumpur, following the rally.

The other members of the panel are former chief justice of Borneo Tan Sri Steve Sim, Kumpulan Akhbar Sinar Harian managing director Datuk Husammuddin Yaacub, Sin Chiew Group legal advisor Liew Peng Chuan, Petronas Corporate Affairs senior general manager Datuk Medan Abdullah and Universiti Kebangsaan Malaysia psychologist Prof Dr Ruszmi Ismail.

Hishammuddin said the inclusion of two serving members of the media, a corporate figure, a psychologist, a retired judge and a former inspector-general of police in the panel was a clear manifestation of the government’s commitment to unveil the truth.

“We welcome the information and feedback brought by several parties, including from the National Union of Journalists (on the panel).

“I wish to state that the panel is made up of six distinguished individuals, including the chairman. It is impossible to satisfy the wants of each and every party, especially that of politicians and those with vested interests,” he said.

Hishammuddin noted that the criticisms against the royal commissions of inquiry on the death of Teoh Beng Hock and VK Lingam judge-fixing video were clear examples of how even the distinguished members of the society were not spared when it involved highly politicised issues.

The Parliamentary Select Committee (PSC) on Lynas Advanced Materials Plant (LAMP) says the rare earth project needs to be handled in a scientific manner.

Chairman Datuk Seri Mohamed Khaled Nordin said this is necessary as questions raised by certain parties on the project’s credibility and safety were scientific and technical in nature.

“The PSC will recommend that all ideas presented will be evaluated in terms of its scientific credibility and efforts will be made to get scientific experts to give independent views,” he told reporters after the PSC public hearing session at Universiti Malaysia Pahang (UMP) campus here today.

The session was attended by seven public groups and six PSC members including MP for Kulim-Bandar Baharu, Datuk Zulkifli Noordin and MP for Kota Belud, Datuk Abdul Rahman Dahalan.

Mohamed Khaled said the Lynas issue requires transparency in every aspect including information supported by scientific proof as only then could public confidence be restored.

“Lynas is a strategic project with big impact on future development of science and technology in Malaysia.

“The responsibility of PSC is to ensure that all concerns, recommendations and public comments are given serious attention. This is to ensure that the project will not be harmful to the health, public wellbeing and environmental sustainability.”

Mohamed Khaled said the public hearing session showed that not everyone was against the project as some even agreed that it be continued.

“However, this requires extremely stringent enforcement measures to ensure compliance,” said the minister of higher education.

The PSC will hold another hearing on May 21 in Kuala Lumpur and all findings on that date, the Lynas plant visit, and public hearing yesterday and today will be presented to parliament during the June session

Bersih: Hanif panel biased, powerless

 

Bersih dismissed today Putrajaya’s panel to probe the violence at the electoral reforms movement’s April 28 rally, saying the team led by former police chief Tun Hanif Omar would be biased and “nothing more than a glorified task force.”

Prime Minister Datuk Seri Najib Razak had pledged last week that “credible, experienced and respectable” individuals would investigate the events during Bersih’s third rally for free and fair elections, which descended into chaos after police clashed with protestors.

But Bersih pointed out in a press statement today “no indication has been given by the government as to what law will regulate the establishment and functioning of this panel.”

“If it is not to be constituted under any existing law relating to commissions of inquiry, the panel will have no power to summon witnesses, no power to insist that documents and information be produced, and no power to grant immunity to any person giving evidence to it,” it said.

The coalition of 84 civil societies added that panel chairman Hanif “has already made two public comments... that communist sympathisers who were active demonstrators in the 1970s were involved.

“He has also agreed with Najib’s allegation that Bersih 3.0 was an attempted coup d’état against the government. By so doing, he has shown that he is biased and has already pre-judged the outcome of the investigation,” Bersih said.

It also noted that another panel member would be Datuk Medan Abdullah, who is corporate affairs senior general manager for state oil company Petronas. Bersih asserted that, as an employee of a GLC, Medan would not be independent.

Najib’s choice of the former Inspector-General of Police to head the panel came under immediate fire from the opposition and calls are growing for Hanif, who led the police for two decades since 1974, to recuse himself.

Chaos reigned on the streets of Kuala Lumpur for over four hours after 3pm on April 28 when police fired tear gas and water cannons, and chased protesters down the streets to disperse what had initially been a peaceful protest calling for free and fair elections.

The Bar Council has said its observers found that police brutality at the rally was “magnified” compared to already chaotic scenes during a similar gathering for free and fair elections last July 9.

Police had begun firing the tear gas and water cannons after some demonstrators breached the barricade in front of Kuala Lumpur City Hall (DBKL) and rushed into Dataran Merdeka, which the courts had barred the public from entering that particular weekend. They fired as far as the DBKL premises, which are across Jalan Parlimen, and the move broke up the crowd who fled helter-skelter but police chased them down at Jalan Tun Perak and Jalan Raja Laut.

Bersih added today that Putrajaya should accept the offer from United Nations’ special rapporteurs on freedom of opinion and assembly to carry out independent investigations and the Malaysian Human Rights Commission to hold a public inquiry into the events of April

All Malaysians already know that UMNO never appoints a truly independent committee / commision / panel, etc. to investigate anything. Even RCIs are automatically stacked with "YES" men / women so the outcome is never in question.
Never trust anything that UMNO does.

Since the panel is not constituted under a law, it will be a waste of time because the panel will have no authority in making its probe. Furthermore, it will just be a collection of views from the panel itself and almost certainly will be a one sided bias opinion. The chairman heading the panel ought to know that being a policeman before and after making statements before the probe is definitely not qualified to sit in the panel. He should disqualify himself and show others he has credibility and integrity.

The appointment of former inspector-general of police Hanif Omar to head the independent panel to probe incidents of violence during the Bersih 3.0 rally has raised deep public concerns that the investigation will either be a whitewash of police brutality on peaceful demonstrators, a massive cover-up of the sufferings of the victims, or a pretext to justify BN's wild lies that Bersih 3.0 was a coup d'état attempt.

Hanif, who is now Genting Malaysia Bhd deputy chair, had claimed that communist sympathisers were involved in the Bersih 3.0 rally, and supported Prime Minister Najib Abdul Razak's claim that the Bersih 3.0 rally was an attempt to overthrow the government.

Hanif further stated that the tactics of using provocateurs to cause the demonstrators to clash with police and to bring children along in the hope they would get injured, were tactics learnt from past pro-communist demonstrations.

How can Najib consider Hanif as a "credible, experienced and respectable" individual that ensures its investigation panel is independent and unbiased, when Hanif has adopted such a prejudiced and partisan stand against the Bersih 3.0 rally as an attempt to overthrow the government?

What makes those claims of a coup d'etat by Najib and Hanif most ridiculous is that both ignored the fact that six local pressmen and about 12 photographers and journalists from the foreign media were reportedly assaulted during the fracas on April 28 Bersih 3.0 rally by police.

To add insult to injury, Hanif is now heading the investigation panel raising doubts about the integrity, reliability and credibility of its findings.

As a former inspector-general of police, Hanif is first and foremost disqualified from serving on the investigation panel due to conflict of interest as the police is being accused.

Secondly, by publicly condemning Bersih, Hanif's bias and prejudice would also disqualify him to serve on the investigation panel.

Finally, by linking Bersih to communism, Hanif is still fighting yesterday's long-concluded wars, making the outcome of these investigations a foregone conclusion.


 

For these reasons, the prime minister should try to salvage or restore some credibility and public confidence as well as renew faith that "justice will not only be done but be seen to be done" by replacing Hanif with an independent, apolitical, unbiased and an upright person of integrity.

From Utusan to NST to the Star, Najib shames M'sia

The United Nations in Malaysia would like to refer to the article published in The Star newspaper on May 7, 2012 titled “Police: Tear gas used at rally safe, UN-approved’.

We very much regret that the UN in Malaysia was not consulted before the publication of this article as it contains serious inaccuracies. The UN has consistently condemned the excessive use of force, including through the use of tear gas.

Please also note that the Office of the UN High Commissioner for Human Rights (OHCHR) and Special Procedures of the Human Rights Council have on various occasions publicly expressed concerns about reliable reports indicating that civilians who died from tear gas suffered complications from gas inhalation, and that security forces have been firing metal tear gas canisters from grenade launchers into crowds.

The UN Special Rapporteur on Freedom of Expression after his mission to the Israel and Occupied Palestinian Territories (OPT) in December 2011 noted that "while the use of tear gas to disperse a crowd may be legitimate under certain circumstances, tear gas canisters should never be fired directly at demonstrators."

Moreover, unlike what is alleged in the article, the UN does not set international standards on different kinds of irritants, nor has the UN approved ‘CS Gas’ as a ‘riot control’ agent.

Journalists AND public officials should be professional

As far as the use of force is concerned, the relevant UN instrument is the Basic Principles on the use of Force and Firearms by Law Enforcement Officials, which was adopted by the Eighth United Nations Congress on the Prevention of Crime and the Treatment of Offenders in 1990, not the Chemical Weapons Convention (CWC) of 1993. I provide its general provisions below:

  1. Governments and law enforcement agencies shall adopt and implement rules and regulations on the use of force and firearms against persons by law enforcement officials. In developing such rules and regulations, Governments and law enforcement agencies shall keep the ethical issues associated with the use of force and firearms constantly under review.
  2. Governments and law enforcement agencies should develop a range of means as broad as possible and equip law enforcement officials with various types of weapons and ammunition that would allow for a differentiated use of force and firearms. These should include the development of non-lethal incapacitating weapons for use in appropriate situations, with a view to increasingly restraining the application of means capable of causing death or injury to persons. For the same purpose, it should also be possible for law enforcement officials to be equipped with self-defensive equipment such as shields, helmets, bullet-proof vests and bullet-proof means of transportation, in order to decrease the need to use weapons of any kind.
  3. The development and deployment of non-lethal incapacitating weapons should be carefully evaluated in order to minimize the risk of endangering uninvolved persons, and the use of such weapons should be carefully controlled.
  4. Law enforcement officials, in carrying out their duty, shall, as far as possible, apply non-violent means before resorting to the use of force and firearms. They may use force and firearms only if other means remain ineffective or without any promise of achieving the intended result.
  5. Whenever the lawful use of force and firearms is unavoidable, law enforcement officials shall:

( a ) Exercise restraint in such use and act in proportion to the seriousness of the offence and the legitimate objective to be achieved;

( b ) Minimize damage and injury, and respect and preserve human life;

( c ) Ensure that assistance and medical aid are rendered to any injured or affected persons at the earliest possible moment;

( d ) Ensure that relatives or close friends of the injured or affected person are notified at the earliest possible moment.

  1. Where injury or death is caused by the use of force and firearms by law enforcement officials, they shall report the incident promptly to their superiors, in accordance with principle 22.
  2. Governments shall ensure that arbitrary or abusive use of force and firearms by law enforcement officials is punished as a criminal offence under their law.
  3. Exceptional circumstances such as internal political instability or any other public emergency may not be invoked to justify any departure from these basic principles.

We at the United Nations appeal to all journalists to correctly and accurately research and report all matters and procedures related to the UN. We believe that such professionalism should also extend to all public officials.

Five others on the six-member panel will comprise academicians, former judges and media presentatives.

Hanif was the fourth and longest serving police chief in Malaysia.

Hishammuddin said that the purpose of the panel is to collect evidence and conduct investigations in order to unravel the truth behind the incident.

He added that should investigations be solely conducted by the home ministry and the police, there will be concerns over the independence of the process.

"Those who claims that they were victims, who claims that there are no avenues to speak up, can raise their grouses through the panel," he said.

On whether foreign police agencies will be roped in to help, Hishammuddin replied that this will be decided by the panel.

On why there are no lawyers or Human Rights Commission (Suhakam) representatives on the panel, Hishammuddin said the Bar Council was already busy with Bersih 3.0 related matters.

He said that it was up to the panel to decide if it requires Suhakam representation on the panel.

Ambiga 'deeply horrified'

In an immediate reaction, Bersih coalition co-chairperson Ambiga Sreenevasan said she is "deeply horrified by Hanif's appointment", especially after his recent comments on Bersih 3.0.

Ambiga said that as a lawyer, Hanif should know that his previous comments would immediately disqualify him and all the other former IGPs who made some extreme statements from sitting on the panel.

"We trust that he will do the right thing and decline the appointment.

"In any event it is our view that the government ought to have appointed Suhakam and accepted the invitation from the UN rapporteur to assist the inquiring panel," she said.

In another immediate reaction, veteran opposition lawmaker Lim Kit Siang said Hanif should decline his appointment.

"He should decline the appointment after his horrific support of Najib's wild allegation on coup d'état attempt or Bersih 3.0 panel will lose all credibility," he said in a tweet.

The Saudi Arabia government is in the midst of deciding whether it should impose restrictions on or enforce a suspension of haj and umrah pilgrims from Malaysia over recent Bersih 3.0 gatherings in Mecca and Medina recently.

Datuk Seri Jamil Khir Baharom told Bernama that Saudi Arabia Ambassador to Malaysia Fahad A. H. Al-Rashid had informed him of the news at a meeting last Friday.

The minister in the Prime Minister’s Department added that he had reiterated the “government’s stand against such misbehaviour involving a small group of people. Furthermore, the protests were staged outside the country.”

He said the Saudi government did not take lightly any form of unlawful assembly, especially after the recent Arab Spring, and as a result, had imposed sanctions on some countries in the past.

Jamil Khir said the government is concerned Saudi authorities may decide to reduce the haj pilgrimage quota and visas approved this year.

Those involved in Bersih 3.0 protests in Mecca and Medina had only served to tarnish the country’s image as Malaysian pilgrims have won praise from the Saudi king for their discipline in the past, he added.

Speaking on a separate issue, the minister said the Islamic Development Department would cooperate with the Home Ministry to get a book on marriage by Middle Eastern Study Group banned as its contents allegedly condone same-sex relationships.

Knowing too well that so many buildings which include hotels are demolized to make way for new bigger hotels some are still in progress, so definitely the Saudi government have to reduced the number of pilgrimages not only from Malaysia but all over the world because of not enough accommodation. Participants of the Bersih 3.0 rally on April 28 who are wanted by police have been given one week to surrender.

Bukit Aman Crime Investigation Department (CID) Director, Datuk Seri Bakri Zinin, said starting next Wednesday, the police will begin making house calls to arrest the culprits.

Police have also established a task force comprising officers and staff to track those involved in the rally organised by non-governmental organisations (NGOs), he told a press conference at Kuala Lumpur police headquarters here today.

He said that all 129 rally participants whose photographs were distributed via the media should surrender themselves to a police station accompanied by their respective lawyers.

Of the 141 participants whose photographs were published in the media, only 12 have been arrested so far. Of the number, eight were charged while the rest were released.

Bakri said police have opened 43 investigation papers involving the rally with 22 of them on public reports against the police and 21 reports against the rally.

“The police will conduct a fair and thorough investigation based on each report made,” he added.

Najib added that he, along with the entire government and members of the public, are keeping a close eye on investigations into the allegations that journalists, both local and foreign, had been roughed up during the rally for free and fair elections.

Another dog and pony show in the offing....perhaps it should be a cat and pony show instead,given the religious sensitivities.They are obviously intent in nailing BERSIH,specifically Ambiga when it is plain obvious the authorities could have save everyone grief by agreeing to a peaceful sit-down at Dataran in the first place!Remember it was afterall for free and fair electoral reforms and not some revolution to overthrow the government as they claim!

Surely you can find someone who has no links to the police previously and presently. Then the commission will look more transparent. Why not the former Lord President Tan Sri Salleh Abbas? I think he will be much better than Hanif Omar. Police to investigate police? So pathetic

Malaysians must support Datuk Seri Najib Razak in upcoming polls as a strong Barisan Nasional (BN) government would be able to revive the Internal Security Act (ISA), Tun Dr Mahathir Mohamad was reported as saying yesterday.

The former prime minister was quoted by Chinese vernacular newspaper Kwong Wah Daily as saying that Najib had been forced to accede to Pakatan Rakyat’s (PR) demands and abolished the ISA as he feared losing electoral support.

According to the Penang-based daily, Dr Mahathir blamed Najib’s predecessor, Tun Abdullah Ahmad Badawi, for transferring a weak BN government to the prime minister, which resulted in Najib having to bow to demands from the federal opposition.

Kwong Wah was the only newspaper that carried Dr Mahathir’s remarks on Najib and the ISA.

The news report also quoted Dr Mahathir as defending the relevance of the ISA, saying that if ex-Communist Party of Malaya secretary-general Chin Peng or a religious extremist were to form a political party here, such detention laws would be the only way to stop these threats.

The country’s longest-serving premier stressed that the government could only revive the ISA if BN gained more seat wins in the next general election.

Prime Minister Najib announced the repeal of the ISA along with other security laws back during his Malaysia Day address on September 16 last year. It was repealed in the March parliamentary sitting.

The ISA replacement law, Putrajaya’s Security Offences (Special Measures) Act 2012 was tabled and passed in Parliament last month, removing the government’s option to detain individuals without trial and providing a maximum detention of 28 days for investigation purposes.
