A government pathologist who performed the second post-mortem on Teoh Beng Hock last November, told the inquest into his death today that the DAP aide died from a fall, and also disputed Dr Porntip Rojanasunan’s conclusion that he had been strangled or had his anus penetrated before he fell.
Sungai Buloh Hospital Pathology Unit head Dr Shahidan Md Noor, also said that he agreed with the findings of the first post-mortem which was carried out by Dr Khairul Azman Hj Ibrahim and Dr Prashant Naresh Samberkar.
“I think that Dr Khairul and Dr Prashant had executed their tasks very well. It is difficult to find a report as good as that. I agree with their opinions,” said Dr Shahidan.
The post-mortem examination report submitted by Hospital Sungai Buloh attributed the cause of death to “multiple injuries due to a fall from height.”
Dr Shahidan informed the coroner’s court that although there was evidence of bruises and contusion on the neck of the deceased, there were no signs of asphyxia or fracture of the thyroid cartilage.
The doctor’s opinion was that the bruises on Teoh’s neck was not a result of manual strangulation.
He disputed the testimony of Dr Porntip, who was brought in last year by the Selangor state government to offer her expertise.
“I disagree with Dr Porntip. When strangulation takes place, the pressure from the hands on the neck would be different, and would be more consistent on the area of the neck,” when questioned by lead counsel for the Attorney-General chambers Tan Hock Chuan on why he disagreed with the Thai pathologist.
The pathologist from Hospital Sungai Buloh also disputed the foreign pathologist’s take on the injuries on Teoh’s anus and thigh area, maintaining that the injuries were a direct result from the fall.
Dr Porntip had testified on Oct 21 last year that the injuries on Teoh’s anus had been caused by an insertion of a foreign object, and that the injury was not consistent with the fall from height.
Similarly, she also suggested that the abrasions on Teoh’s thigh was likely caused by beating using a piece of wood.
“I think that the anal injury was a part of the fall, as the patterns of injury suggest so. If it had happened prior to the fall, the injuries sustained by Teoh Beng Hock would have been different,” said Dr Shahidan.
He stressed that if Teoh had been assaulted the way Dr Porntip had suggested, the anal injuries would have been more severe.
“The abrasions on the thigh does not suggest a beating but it suggests a process that can only be a result of an injury caused by a fall,” he added.
Excerpts of the conclusion of the post-mortem examination report by Dr Shahidan read out as follows:
“The second examination performed showed that the deceased sustained multiple injuries consistent with that of a fall from a certain height. There were also injuries on the neck which most likely were formed or produced by the impact of the fall. The pattern and severity of them were in keeping with the incident of event.”
Lead counsel for the deceased’s family, Gobind Singh Deo then requested for more time to view the notes taken today with regards to Dr Shahidan’s opinion on Dr Porntip’s testimony.
Magistrate Azmil Muntapha Abbas then fixed March 1 for Gobind’s cross-examination of Dr Shahidan.
Besides that, an additional date of March 10 was also fixed should the cross-examination take up more than a day. After the cross-examination is completed, Kajang councillor Tan Boon Hua will be called to testify.

First of all, Dr Pornthip has more credibility than this Umno government pathologist Dr Shahidan Md Noor. May i ask Dr Shahidan, how could he know the bruises on TBH neck was a result of his fall? The neck is considered as some area that could not be easily reached, unless it is targetted, so how could a fall leave bruises on the neck? The neck is protected by the shoulder and the head.
Let us hope that Dr. Pornthip will conclusively proved beyond reasonable doubts the cause of the death of Teoh Beng Hock. As usual we cannot expect truth to come out from the mouths of the Government pathologist!
Dr Shahidan, you can now throw your forensic degree into trashcan, instead, get your new certification from UMNO's BTN office.
How can a fall result in the anus being penetrated? Will a fall result in the rectum being penetrated? Is the word "responsible" ever present in the dictionary of the MACC? Malaysia looks forward to a fair inquest and let those responsible for the death of Teoh Beng Hock must face the music! Let us hope that the inquest be a fair one, that will not end up in disappointment for everyone, without conclusive findings and decision! Let not this inquest be a waste of the public time and monies! Malaysia waits!

Biker killed in crash involving ex-Perak MB
A motorcyclist was killed when he was involved in a crash with former Perak menteri besar Datuk Seri Mohd Tajol Rosli Ghazali’s sports utility vehicle at Km28.1 Jalan Kuala Kangsar-Gerik here today.
Plantation worker Rina Kumala, 23, was said to have made a U-turn after coming out of a junction when the accident occurred at 10.55am, said Gerik police chief Supt Mahad Nor Abdullah.
He said Tajol Rosli, who was driving a Toyota Harrier, failed to avoid the motorcyclist.
Mahad said Rina succumbed to head injuries while being treated at a clinic in Lenggong, one hour later.
Tajol Rosli, who is Pengkalan Hulu assemblyman, was on his way to the Gerik Rest House with two friends to attend a ceremony. — Bernama

National Malay chamber sec-gen lodges report against Penang official
The Malay Chamber of Commerce Malaysia secretary-general Datuk Abdul Rahim Abu Bakar has lodged a police report against Penang Malay Chamber of Commerce (DPMPP) president Rizal Faris Mohideen for allegedly threatening him and attempting to assault him at the Penang International Airport last Wednesday.
Abdul Rahim lodged the report at the Selayang police station on Feb 12.
According to the report, Abdul Rahim said that at about 10am on Feb 10, he was with Melaka Malay chamber chairman Datuk Md Ramli Mohamad and Terengganu Malay chamber deputy president Abdul Razak Yaacob at the airport when they bumped into Rizal.
Abdul Rahim said Rizal shouted at them and also used harsh words including "babi, sial, binatang, barua, kurang ajar".
Rizal allegedly warned them to be careful as he was "after them" and tried to hit Abdul Rahim with his hand but was prevented from doing so by Ramli.
"I left the place immediately as I did not want to entertain him, but he told Razak that he
would shoot me and throw his shoes at me at the forthcoming meeting," Abdul Rahim stated.
He said he lodged the report for fear of his, his family's and friends' safety.
Hardly two hours after the alleged incident, Rizal lambasted Abdul Rahim for meeting up with Chief Minister Lim Guan Eng behind his back the night before.
At a press conference on Feb 10, Rizal said he had written a strongly-worded letter to the headquarters and to the president, and distanced himself from Abdul Rahim.
He said Abdul Rahim had never set foot in Penang to check out what was actually happening here or the situation of the Malays in Penang.
He also accused Abdul Rahim of seeking cheap publicity for himself and playing politics.
At the conference, Rizal also called Lim a liar, dictator, political reject and
hypocrite, among other names.
The national delegation had met Lim for a dialogue following a flare-up between the DPMPP and Lim's administration.
The DPMPP had accused the state government of neglecting the Malays in
the state, including intensifying enforcement action against Malay traders.
The DPMPP had also mobilised other Malay and Muslim non-governmental
organisations to stage a demonstration against Lim's administration after Friday
prayers on Feb 5.

And I am very perplexed why those who have rejected Islam are eager to conduct such celebrations,”

Anwar fails to recuse judge from sodomy trial
Datuk Seri Anwar Ibrahim has failed to recuse the judge Judge Mohamad Zabidin Mohd Diah from presiding over the sodomy trial involving him and the alleged victim Mohd Saiful Bukhari Azlan where the judge ruled that he did not see any reason to recuse himself. Anwar had last week applied to disqualify Zabidin on grounds that his 2 decisions pertaining to the news reports on Utusan Malaysia raised an element of bias. Zabidin said “If I recuse myself in such circumstances, it will mean that I am running away from my responsibility as a judge. A judge who has taken an oath of office should not avoid carrying out the duty which has been entrusted to him. There must be facts to show that a rational person would think that there was a possibility that the judge will make his decision over the tried issues not based on the evidence adduced in court, but on other considerations,”
The trial would have continued as Karpal Singh, Anwar’s lead counsel said that he was prepared to cross-examine Saiful but would appeal over the recusal ruling. He said “We do not want to be accused of delaying tactics. It has to be taken out from the mind of the judge, the prosecutors and everyone. We do not want Pemuda Umno to go wild. There is a black hand behind the whole prosecution,”
The judge then granted a stay pending disposal of the appeal on the recusal ruling and set March 25 for mention. He said “It is important for a higher court to decide on this matter to avoid any violation of principles. If the Court of Appeal decides that my ruling on the recusal application is erroneous, then as stated by the case law, it will only make the proceedings nugatory,”

Karpal told the court “As I said, there’s a black hand in this trial, and that is the hand of the present Prime Minister..there are two hands and one is of his wife,”
The Prime minister and his wife have been listed as witnesses in the case. Karpal was addressing the court after their application to recuse High Court judge Datuk Zabidin Mohd Diah failed. Zabidin said “If I were to step down from this trial, I would be running away from my responsibility as a judge who has taken an oath of office,”

BN leaflets ridicule Ku Li over oil royalty stance
The Kelantan Barisan Nasional (BN) is allegedly using the state education department to distribute leaflets in local schools to ridicule Tengku Razaleigh Hamzah’s stance that the PAS-ruled state is entitled to a 5 per cent oil royalty rather than the RM20 million compassionate payment offered by Putrajaya.
A few teachers told The Malaysian Insider that they have received the leaflets last week, weeks after the Gua Musang MP spoke out against his Umno party at a forum in the Stadium Sultan Mohamad IV Kota Baru in late January. Razaleigh is the founding chairman of state oil firm Petronas and has said all oil-producing states are entitled to the 5 per cent oil royalty.
“Yes, the leaflets are being distributed... a few teachers have received it and it smears Tengku Razaleigh. In fact, a lot of students have also received the leaflet,” said a teacher attached to a school in state capital Kota Baru, referring to the A4-sized leaflet.
“If I am not mistaken, the leaflet came out a few days after Tengku Razaleigh spoke at the stadium,” said the teacher who asked for anonymity.
He said certain parties had sent the leaflets to his school for distribution among the teaching staff and students. Umno said it will study remarks made by the Kelantan prince, popularly known as Ku Li, although a few others have called for action against the veteran leader.
An Umno divisional leader confirmed to The Malaysian Insider that the leaflet will be distributed at an Umno-organised oil royalty ceramah this Friday. The ceramah will headline Kelantan Umno chairman Datuk Seri Mustapa Mohamed, his deputy Datuk Dr Awang Adek Hussin and Malay rights group Perkasa president Datuk Ibrahim Ali.
The leaflet contains Ku Li’s opinions about oil royalty for Kelantan made last month and another statement allegedly made in 2000 over oil royalty for Terengganu. Terengganu only received compassionate payments made through federal agencies when PAS won the state in the 1999 general elections.
The leaflet is titled “Ku Li tipu rakyat, Tok Guru Kena Tipu Pulak!” (Ku Li cheats the people, Tok Guru is also cheated!) with pictures of Razaleigh and Kelantan Mentri Besar Datuk Nik Aziz Nik Mat.
Another teacher said the state Education Department had been tricked into distributing the leaflets by the BN.
“A few officers from the state education department and the district education department have spoken about this issue. Strictly speaking, this has nothing to do with their work,” said the teacher who only identified himself as Awi.
He also disclosed that a National Conference of Secondary School Headmasters was held at a Kota Baru hotel on Feb 1 which was attended by Mustapa. He claimed that Mustapa later met the state education department and local headmasters to discuss the oil royalty issue.
“They spoke about the oil royalty at that special meeting. That is all that I was told and also the leaflets was distributed. People thought it was strange that Tok Pa (Mustapa) attended the meeting of teachers and education officers.
“For those who know, they know it had a political agenda,” he added.
Kelantan Umno has ticked off Razaleigh for having his own agenda to go against the party’s stand over the oil royalty with the Kelantan Umno Youth urging him to quit his Gua Musang seat and move to PAS or any other Pakatan Rakyat party. Other Umno leaders have asked for action to be taken against Ku Li with deputy Umno president Tan Sri Muhyiddin Yassin asking the party veteran to review his position in the party.
Mustapa, who is International Trade and Industry Minister, said yesterday that the RM20 million compassionate payment will be distributed at the end of March particularly for the poor.

BN, Perkasa protest at Australian mission
The Barisan Nasional Youth and Malay rights group Perkasa gathered separately outside the Australian High Commission here today to protest against 50 Australian MPs who had asked for Datuk Seri Anwar Ibrahim to be freed of his sodomy charge.
BN Youth claimed it gathered 600 members headed by chief Khairy Jamaluddin and his Umno Youth deputy, Datuk Razali Ibrahim for the gathering. Khairy later led a delegation to hand over a protest memorandum to High Commissioner Penny Williams.
The crowd had earlier gathered at a nearby restaurant some 200 metres from the mission as early as 8.30 am and later marched towards the building carrying placards, banners with “Don’t Mess With Our Affairs!”, “Jaga Negara Sendiri (take care of your own country)” written on it.
As they marched, the crowd shouted “mind, mind, mind your own business” and “to hell with Australia”.
A Light Strike Force squad was deployed to form a barricade and prevent the crowd from gathering at the mission’s outer compound.
Only Khairy, Razali and MIC youth chief T Mohan were allowed to pass through the barricade.
Khairy later told reporters that he had met Australian High Commissioner Penny Williams to hand over the memorandum, which among others, demanded the Australian government to make their stand on the issue clear.
“We also want an open apology from the 50 MPs and we want them to retract the petition,” he said.
“This act is a clear interference with our internal affairs and an encroachment to our sovereignty and we will tolerate none of this,” Khairy added.
The BN and Umno Youth chief said the Australian High Commission had assured him that their government has no intentions of meddling with Malaysia’s affairs and are not prejudging the ongoing Sodomy II trial, a charge Anwar and other opposition leaders claimed is “trumped up” to kill its surging influence.
Khairy, however, slammed the accusations and said he believed the ongoing trial will take place in a transparent and fair manner unlike what is claimed by the opposition.
The 50 Australian MPs last week said the Malaysian government should drop the sodomy charge against Anwar, who leads the Pakatan Rakyat opposition pact. Anwar is charged with sodomising his former aide Mohd Saiful Bukhari Azlan on June 26, 2008.
The former deputy prime minister has denied the charge, the second such charge in 12 years.
Perkasa president and Pasir Mas MP Datuk Ibrahim Ali, who led his own members behind the BN Youth, was less diplomatic when stating his view to reporters outside the Australian High Commission.
Ibrahim said the reason why Michael Danby, the MP who led 49 others to hand in the petition calling for the charge to be dropped, is “supporting” Anwar is because he is a homosexual, a derogatory description leveled against Anwar by his political rivals.
“Birds of a feather flock together.I heard that Danby is a homosexual.” The BN Back Benchers Club (BNBBC) also sent a separate protest note at 11.15 am.
BNBBC deputy chairman Kinabatangan MP Datuk Bung Mukhtar Radin handed over their protest memorandum to Williams.
Bung Mukhtar told reporters that Williams had assured them that the views of Danby and the 49 MPs do not represent the Australian government’s stand.
He also said that the Australian MPs should not be carried away by Anwar’s side of the story. The opposition icon has been vigorously engaging the international media in a bid to woo support. “The case is not approached by the government but Saiful,” said the Kinabatangan MP. “Because the case is not broached by the government so how can they ask the judiciary to drop the case?” he added.

KJ, BN and Perkasa are known for their stupidity. Do you really think the Malaysians are stupid especially a Malay like me? It is so obvious that there is no justice in our judiciary system. Malaysian government has lost its credibility to its own people. This is a fact.

BN and Perkasa should start asking themselves how they could elect an UMNO minister who tells the world it's ok our new submarine cannot dive, or how non-malay students with straight A's cannot get a place in a local uni, or how we could lose a frigate in the South China Sea without anyone noticing it? So how is it the judge even allows the case to continue when medical reports show no penetration in Anwar's case, and you call that justice? So, is everone out in the world is wrong, and BN and Perkasa is correct? Come on... get a life.
This is the 1st circus show performed by a group of UMNO-BN Clowns in Celebration of the Year of Tiger. The Australians must be pretty amazed by the immaturity of the UMNO-BN politicians; no sight of growth after 50 yr of independence. To these UMNO-BN politicians, democratic means saying and doing things they like. Anything to that contrary is "infringing their sovereignty".

Sorry mate, u're too ancient for this generation, your techniques may appeal to those in your age group which is 60 and above and whether you like it or not, the new generation are more prectical sensible people who want peace and tranquility. so my 2 cents of of advice would be, go to sumatra or acheh and make your point u may appeal to them with a younger generation probably
Najib’s embarrassing Pandamaran welcome
No amount of justification can change the fact that the giant billboard and other banners to welcome Prime Minister Datuk Seri Najib Razak to Pandamaran for the national-level Chinese New Year celebrations were illegal.
This has been confirmed by staff at the Klang Municipal Council (MPK) who acted within the law to remove the mammoth billboard and other banners which were reportedly sponsored by companies linked to the organisers for the Feb 20 event.
“What do you expect? They didn’t even apply for a permit. We would have had to take action even if the banners was put up by PAS or PKR.” said the irritated officer, who pointed out the blame should fall squarely on organisers.
Yet this fact has been overlooked, probably deliberately by local Barisan Nasional (BN) leaders who have been quick to blame the Pakatan Rakyat (PR) state government for disrespecting Najib and politicising the issue by ordering MPK to act.
Main stream newspapers have gone to town with the statements from Selangor Umno information chief Abdul Shukur Idrus, Klang Umno chief Datuk Mazlynoor Abdul Latif and Klang Barisan Nasional chairman Datuk Teh Kim Poo.
Laws including local government requirement for permits are there for a reason. And that includes health and safety.
No one should know these better that Abdul Shukur who is Kuang state lawmaker, Mazlynoor who was former MPK councillor and Teh who was formerly both Pandamaran state lawmaker and MPK councillor.
Are these leaders suggesting that MPK turns a blind eye to the violation just because the illegal billboard was meant to welcome Najib? Will they defend MPK should the illegal structure falls, hurts or even kills someone?
By justifying the unjustifiable, aren’t they the ones embarrassing the prime minister?

Please go law by law. You must apply for a permit. It is not a state function. If it was then state officials should have been represented. It looks like a BN function. BN must apply for permit. The days when BN can do anything you like are over!...

Umno Youth meets Najib amid rumours of infighting
The Umno Youth executive committee will meet Datuk Seri Najib Razak this evening amid rumours of attempts by certain leaders from the wing to unseat its chief Khairy Jamaluddin.
An Umno Youth committee member confirmed the scheduled meeting but described it as a “courtesy visit” and has nothing to do with the heated exco meeting that took place late last month.
During that meeting, Umno Youth exco Hishamuddin Yahya was said to have told Khairy to quit for being ineffective.
Hishamuddin had also called for fresh election to choose a more effective line-up of Youth leaders.
“The meeting was a place for us to address our differences, there is some truth to what was leaked but it is still not too serious, let us meet the PM first,” an Umno Youth exco member said on condition of anonymity.
Another Umno Youth insider said the visit to the party president had been planned since the last party election and it was only a coincidence that the date was confirmed after the heated meeting.
The Malaysian Insider understands some Umno Youth exco members were also unhappy with the stand taken by Khairy on the “Allah” row and the attacks on the places of worship.
“He should have called for an emergency exco meeting for us to deliberate on a common stand and not act all by himself,” said another Umno Youth exco member.
Khairy had reportedly said Umno has been straying from middle ground on the issue. He also supported the use of the word “Allah” by non-Muslims in East Malaysia but not in the Peninsula.
The consensus among Umno Youth leaders opposed to Khairy’s leadership was that the first-term Rembau MP has failed to bring together supporters of Datuk Seri Dr Khir Toyo and Datuk Mukhriz Mahathir, whom he defeated during party election in March last year.
But after report of the rift surfaced, Khairy made known on his Facebook status that he was attending an Umno Youth function in Labuan with Hishamuddin.
Days later, he appeared together with Mukhriz at a Juara Rakyat event in Jerlun, Kedah, and several pictures of them were also uploaded on Khairy’s facebook page.
Khairy, who is former prime minister and Umno president Tun Abdullah Ahmad Badawi’s son-in-law, is the first Umno Youth chief in many years not to get a Cabinet post. The only other one in recent history is Datuk Ahmaf Zahid Hamidi in 1993.
His deputy Datuk Razali Ibrahim was made the deputy youth and sports minister after Najib took over the government last year while Mukhriz was appointed deputy minister of international trade and industry.
Khairy himself will prove his credentials this morning by leading the wing to send a protest note to the Australian High Commission over calls by 50 Australian MPs to Putrajaya to drop the sodomy charges against Opposition Leader Datuk Seri Anwar Ibrahim.
Malay rights group Perkasa will send a similar protest note at 10am, 30 minutes after the Umno Youth leader is scheduled to hand the wing’s protest memorandum.

remember that old quotes by Frank Lloyd Wright; "Wealthy people are little more than janitors of their possessions." This is exactly how we Rakyat Malaysia look at UMNO/BN, busy winning contracts and Swindling the rakyat money. There's no place for you and UMNO/BN in the next 10 to 15 years
